ORDINANCE NO. ~' /~
AN ORDINANCE VACATING, ABANDONING AND CLOSING TWO PORTIONS
OF THE 2000 BLOCK OF WEST ROSEDALE STREET ADJACENT TO LOT
1, BLOCK B, MISTLETOE HEIGHTS ADDITION; PROVIDING FOR
REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT THE two certain portions of the 200 block of West Rosedale
Street lying adjacent to and on either side of Lot 1, Block B,
Mistletoe Heights Addition, and being more particularly described by
metes and bounds in Exhibits "A" and "B", attached hereto and
incorporated herein for all purposes, be and the same are vacated,
abandoned, and permanently closed and extinguished as part of the
public street right-of-way.
SECTION 2
That the fee to the land in the above described vacated portion
of the public street right-of-way is hereby released and shall
revert to the adjacent owner as provided by law, SAVE AND EXCEPT
that an easement is retained in that portion described in Exhibit
"B" for existing and prospective storm drainage utility facilities.
SECTION 3. _
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so
ordained.

A portion of West Rosedale Street which lies north of Lot 12 of
Trezevant Subdivision in the City of Fort Worth in Tarrant County,
Texas as said Subdivision appears upon the map recorded in volume 204,
page 32 of the Tarrant County Deed Records and which lies east of
Block B of Mistletoe Heights, an Addition in the City of Fort Worth as
said Block appears upon the map recorded in volume 388, page 5 of the
said Deed Records.
Beginning at a mark "Y" on concrete for the northeast corner of said
Lot 12 and northeast corner of the tract described in the deed to
Surgery Center of Fart Worth, Inc. recorded in volume 7391, page 2227
of the said Deed Records, in the west line of right of way of 12th
Avenue;
Thence south 89 degrees-49 minutes-27 seconds west, along the north
line of said Lot 12 and said Surgery Center tract, 100-8/10 feet to a
galvanized iron for the northwest corner of said Lot 12 and said
Surgery Center tract, in the east line of said Block B of Mistletoe
Heights, and in the east line of the tract described in the deed to
Surgery Center of Fort Worth, Inc. recorded in. volume 7391, page 2223
of the said Deed Records;
Thence north 5 degrees-03 minutes west, along the said east line of
Block B and said Surgery Center tract, 38-1/10 feet to a galvanized
iron for the northeast corner of said Surgery Center tract, in the
south line of right of way of West Rosedale;
Thence south 78 degrees-23 minutes-18 seconds east, along the
projection of the said south line of right of way of West Rosedale
Street, 105-16/100 feet to the intersection of the said south line of
right of way of West Rosedale Street and the said west line of right
of way of 12th Avenue;
Thence south 3 degrees-59 minutes-33 seconds east, along the said west
line of right of way of 12th Avenue, 16-52/100 feet to the place of
beginning and containing 2750 square feet.

Dr. Dan E Bruh1, owner of a_'.1 abutting property, has requested that the City
D~,~~,~,o~?~o portions of the 2000 block of West Rosedale Street, adjacent to
and on either side of Lot 1, Block B, Mistletoe Heights Addition, from 12th
I~~s~~-west 100.2 to the east property line of said Lot 1, Block B; and from
the west property line of said Lot 1, Block B, and from the west property line
of said Lot 1, Block B, westward 80.07' to a point, said point being 66.64' from
the east right-of-way line of the St. Louis and San Francisco Railroad, as
shown on the attached map.
The subject street right-of-way, acquired by dedication, consists of landscaped
parkway The westernmost portion of the subject right-of-way contains storm
drainage utility facilities and the easternmost portion of the subject right-
of-way contains no utility facilities The subject vacation request is made
in order to replat the vacation rights-of-way with abutting property to expand
the building area and provide more usable yard space
Reviewing City departments and private utility companies have raised no
objections to this request, provided the vacated rights-of-way are replatted
with abutting property and an utility easement is retained/dedicated through
the westernmost portion of the subject right-of-way for the existing storm
drainage utility facilities. A satisfactory replat has been submitted.
The City Plan Commission has reviewed this request and recommends that the
subject street rights-of-way be vacated as requested
Recommendation
It is recommended that an ordinance be adopted vacating two portions of the
2000 block of West Rosedale Street, as recommended by the City Plan
Commission.
