HomeMy WebLinkAboutOrdinance 8793., ~ _ <, s ~~M l e.,~ _ J ORDINANCE NO. ~' /~ AN ORDINANCE VACATING, ABANDONING AND CLOSING TWO PORTIONS OF THE 2000 BLOCK OF WEST ROSEDALE STREET ADJACENT TO LOT 1, BLOCK B, MISTLETOE HEIGHTS ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE two certain portions of the 200 block of West Rosedale Street lying adjacent to and on either side of Lot 1, Block B, Mistletoe Heights Addition, and being more particularly described by metes and bounds in Exhibits "A" and "B", attached hereto and incorporated herein for all purposes, be and the same are vacated, abandoned, and permanently closed and extinguished as part of the public street right-of-way. SECTION 2 That the fee to the land in the above described vacated portion of the public street right-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that an easement is retained in that portion described in Exhibit "B" for existing and prospective storm drainage utility facilities. SECTION 3. _ That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. The subject street right-of-way, acquired by dedication, consists of landscaped parkway The westernmost portion of the subject right-of-way contains storm drainage utility facilities and the easternmost portion of the subject right- of-way contains no utility facilities The subject vacation request is made in order to replat the vacation rights-of-way with abutting property to expand the building area and provide more usable yard space Reviewing City departments and private utility companies have raised no objections to this request, provided the vacated rights-of-way are replatted with abutting property and an utility easement is retained/dedicated through the westernmost portion of the subject right-of-way for the existing storm drainage utility facilities. A satisfactory replat has been submitted. The City Plan Commission has reviewed this request and recommends that the subject street rights-of-way be vacated as requested Recommendation It is recommended that an ordinance be adopted vacating two portions of the 2000 block of West Rosedale Street, as recommended by the City Plan Commission.
