ORDINANCE NO. ~ ~~
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND
EXTINGUISHING THE NORTHERN TEN FEET OF A TWENTY FOOT WIDE
EAST/WEST UTILITY EASEMENT LOCATED IN LOT 11, BLOCK 7-R,
JINKENS HEIGHTS ADDITION; PROVIDING FOR REVERSION OF FEE
IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT THE northern ten feet of the twenty foot wide east/west
utility easement located in Lot 11, Block 7-R, Jinkens Heights
Addition, and being more particularly described as follows:
DESCRIPTION OF THE NORTH 10 FEET OF AN EXISTING 20 FOOT
UTILITY EASEMENT ON LOT 11, BLOCK 7-R, JINKENS HEIGHTS
ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS,
ACCORDING TO PLAT RECORDED IN VOLUME 388-80, PAGE 6, PLAT
RECORDS, TARRANT COUNTY, TEXAS, AND BEING DESCRIBED AS
FOLLOWS:
BEGINNING at the point situated 10.0 feet North 00 degrees
17 minutes West from the Southwest corner of said Lot 11;
THENCE North 00 degrees 17 minutes West along the West
line of said Lot 11, 10 0 feet;
THENCE North 89 degrees 56 minutes East 66 16 feet to a
point in the East line of said Lot 11;
THENCE South 00 degrees 11 minutes West 10.0 feet to a
point situated North 00 degrees 11 minutes East 10.0 feet
from the Southeast corner of said Lot 11;
THENCE South 89 degrees 56 minutes West 66.08 feet to the
place of beginning.
be and the same is vacated, abandoned, and permanently closed and
extinguished as a utility easement.
SECTION 2.
That the fee to the land in the above described vacated utility
easement is hereby released and shall revert to the adjacent owner
as provided by law, SAVE AND EXCEPT that an easement is retained in
the southern ten feet of the existing easement for any and all
existing and prospective utilities, including the existing sanitary
sewer facility.

SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

~srle~3.~i~Le11 Burchfield, owner of all abutting property, has requested that
the City vacate the north 10' of a 20' wide east/west easement located within,
"I~iT~~Fd~l"t~l and adjacent to the south (rear) property line of Lot 11, Block 7-R,
Jinkens Heights Addition, extending 66.16' from the west property line to the
east property line of said Lot 11, as shown on the attached map.
The subject utility easement, acquired by dedication, is platted; the south 10'
contains a sanitary sewer aligned in the same east/west orientation as the
existing easement; the north 10' contains no utility facilities.
Reviewing City departments and private utility companies have recommended
approval of this request provided the south 10' of the existing easement is
retained as a utility easement for the existing sanitary sewer facility.
A satisfactory replat, retaining the south 10' as a utility easement, has
been submitted.
Recommendation
It is recommended that an ordinance be adopted vacating the north 10' of
the 20' wide east/west utility easement in Lot ll, Block 7-R, Jinkens Heights
Addition.
