HomeMy WebLinkAboutOrdinance 8998c~ . c ~A .~ .. ,P ORDINANCE NO. ~ 9 AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THE 1800 AND 1900 BLOCKS OF COVERT STREET, A POR- TION OF THE 5000 BLOCK OF GORDON AVENUE, AND A PORTION OF THE NORTH/SOUTH ALLEY LOCATED IN BLOCK 32, SEMINARY HILL ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; , REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVID- ING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following be and the same are vacated, abandoned and permanently closed and extinguished as public street and alley rights-of-way, respectively: A. The 1800 and 1900 Blocks of Covert Street, a width of 60 feet, from Stanley Avenue westward to Townsend Drive; and B. That portion of the 5000 Block of Gordon Avenue, a width of 60 feet, extending from the above-vacated portion of Covert Street north 350 feet to the north property line of Lot 6, Block 32 and Lot 19, Block 33 of the Seminary Hill Addition; C. That portion of the 15-foot wide north/south alley located in Block 32, Seminary Hill Addition, extend- ing from the above-vacated portion of Covert Street north 300 feet to the north property line of Lots 7 and 18, Block 32, Seminary Hill Addition. SECTION 2. That the fee to the lands in the above described vacated public street and alley rights-of-way is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities in the above-vacated alley right-of-way. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. The subject streets and alley are as shown on the attached map. The subject street and alley rights-of-way were acquired by dedication. The subject street rights-of-way are not open on the ground and contain no utility facilities. The subject alley right-of-way also is not open on the ground but does contain electric and sewer utility facilities. The subject vacation re- quest is made in order to replat the vacated rights-of-way with adjacent pro- perty, to expand the building area, and provide more usable yard space. The subject vacation request was submitted and reviewed prior to the adoption of the City's compensation policy, therefore, compensation for the vacated rights-of-way will not be required. Reviewing City departments and private utility companies have raised no objec- tions to this request provided the vacated rights-of-way are replatted with `~~ adjacent property and the alley right-of-way is retained as a utility easement °~ for the existing electric and sewer utility facilities. A satisfactory replat, dedicating and retaining the necessary and appropriate utility easements has been submitted. The City Plan Commission has reviewed this request and recommends that the subject rights-of-way be vacated as requested. Recommendation It is recommended that an ordinance be adopted vacating the 1800 and 1900 blocks of Covert Street, the southernmost portion of the 5000 block of Gordon Avenue, and the southernmost portion of the 15' wide north/south alley in Block 32, Seminary Hill Addition, as recommended by the C~.ty P1~~~~ ~n.
