FIX- ING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED, DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING, AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas, has here- tofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be improved by raising, grading and filling same and by constructing thereon the follow- ing, to-wit: PROJECT N0. 029-023172-00, UNIT I, BRENTWOOD STAIR ROAD, FROM ENOCH DRIVE TO 115 FEET WEST OF DRUID LANE, to be improved by construction of seven-inch thick hot-mix asphaltic concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high concrete curb and eighteen-inch wide concrete gutter on a forty-foot wide roadway. " PROJECT N0. 029-023-172-00, UNIT II-A, BRENTWOOD STAIR ROAD, FROM 90 FEET EAST OF CROOKED LANE TO RANCH ROAD, to be improved by construction of seven-inch thick hot~mix asphaltic concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high concrete curb and eighteen-inch wide concrete gutter on a forty-four foot wide roadway. ~? _ a together with concrete curbs, gutters, driveways and incidentals to such improvements on proper grade and line where same are not already so con- structed, together with storm sewers and drains and other necessary inci- dentals and appurtenances, all of said improvements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor, contract therefore has been`made'and `ente`red into with Austin Road Company and Concho Construction Company Inc. WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amount per front foot proposed to be assessed against abutting property and the owners thereof, and such esti- mates have been examined, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of streets, avenues, and public places hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof, are as follows, to-wit: s Brentwood Stair Road Unit I, From Enoch Drive to 115 feet West of Druid Lane. The estimated cost of improvements is $133,065.07, the estimated amount per front foot to be assessed against abutting property and the owners thereof for concrete curb and gutter is $5.20, the estimated amount per front foot to be assessed against abutting property and the owners thereof for pave- ment is $23.21, the estimated amount per front foot to be assessed against abutting property and the owners thereof for preparation of right-of-way, top soil, seeding, street lights and traffic markers is $6.46, the total estimated amount per front foot to be assessed against abutting property and owners thereof is $34.87. Brentwood Stair Road Unit II-B, From 90 feet East of Crooked Lane to Ranch Road. The estimated cost of improvements is $882,675.92, the estimated amount per front foot to be assessed against abutting property and the owners thereof for concrete curb and gutter is $5.20, the estimated amount per front foot to be assessed against abutting property and the owners thereof for pavement is $23.31, the estimated amount per front foot to be assessed against abutting property and the owners thereof for storm drain, bridge, preparation of right-of-way, top soil, seeding, street lights and traffic markers is $51.25, the total estimated amount per front foot to be assessed against abutting property and owners thereof is $79.76. ~~ - III. A hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on the /7_,~th day of (~;t;,~` _ `' 19 82 , at 10:00 A.M., in the Council Chamber in the C' y Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give or cause to be given notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes, as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1, emergency effec- tive May 12, 1967. Such notice shall be by advertisement inserted at least three (3) times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least twentyrone (21) days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Act as amended. The City Secretary is further directed to give or cause to be given personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be in writing and shall be given or caused to be given by the City Secretary by depositing such written notice in the United States Mail at least fourteen (14) days before the date of the hearing, postage prepaid, in envelopes addressed to all persons owning or claiming any interest in the respective properties abutting the highways, streets, avenues and public places or portions thereof to be improved, as the names of such persons are shown on the current rendered tax rolls of the City of Fort Worth and at the addresses so shown, or if the name of such respective owners do not appear on such rendered tax rolls, then address to such owners as their names are shown on the current unrendered tax rolls of the City of Fort Worth at the addresses shown thereon. In those cases in which an owner of property abutting a highway, street, avenue or public place or portion or portions thereof which is to be improved is listed as "unknown" on the then current City of Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth tax rolls but no address for such owner is shown, no notice need be mailed. In those cases where the owner is shown to be an estate, the mailed notice may be addressed to such estate. In this connection, the City Secretary shall prepare and file or cause to be prepared and filed with these proceedings a list of the properties to be assessed, the names of those persons owning or claiming any interest in said properties to whom the notice was mailed. together with the last known addresses determined as aforesaid of the respective owners and those persons owning or claiming any interest in said property. The City Secretary shall certify that each of the parties in said list whose address is shown on the then current rendered or unrendered tax rolls of the City of Fort Worth was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of each notice shall be attached to such certificate. The certificate of the City Secretary will be conclusive evidence of the facts therein recited. ~° = , IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Brentwood 90' East of 44 64 Stair Road Crooked Lane to Ranch Road IZ-B Bridge Over Cottonwood 44 N/A Creek in Unit II-A Origin of Project On May 20, 1980 (M&C G-4548), the City Council approved the 1980-81 Capital Im- provement Program (CIP) for street and storm drain improvements. Included in the program are "Access to I-30 Projects", which includes this project. On June 24, 1980 (M&C C-5141), an engineering contract was awarded to Gordon S. Swif t, Consulting Engineer, and Farrington and Associates, as a Joint Venture to design the project and prepare plans and specifications. Improvements Brentwood Stair Road will be improved as a major collector roadway forty feet wide in Unit I to match existing segments and forty-four feet wide in Unit II-A. Improvements include construction of ~7" hot-mix asphaltic concrete pave- went with concrete curb and gutter. Left-turn Lanes will be provided at Morrison Drive, Cooks Lane and Bentley Village Parkway. Storm drainage improve- ments consist of 2,200' of concrete pipe and appurtenances and a bridge over Cottonwood Creek. Receipt of Bids The project was advertised for bids on May 6 and 13, 1982, with bids received on June 17, 1982. Alternates for both 7" hot-mix asphaltic concrete and 6" con- crete pavement were bid. No Bid APAC-Texas, Inc. _ $372,895.44 ***Indicates low bid for Bridge Incomplete Discussion of Bids Received An economic analysis of the two types of pavement bid was made by the engineering staff with the following results: Low HMAC Paving Bid $606,256.75 Present worth of future maintenance costs 105,949.16 Total $712,205.91 Low Concrete Paving Bid $704,028.11 Present worth of future maintenance costs 52,736.00 Total $756,764.11 Therefore, HMAC is low by $44,558.20 Based on the above, the staff recommends the contract be awarded to Austin Road Company based on its low bid for HMAC pavement on Units I and II-A. OATE REFERENCE SUBJECT PAGE NUMBER Award of Contract-Assessment 7/ 20/82 **C-6422 Paving of Brentwood Stair Road 4ot_S__ Project Cost and Financing All of the adjacent property on both sides of the street is developer type property with the exception of six smaller parcels on the south side of Unit II-A. The developers have dedicated the required roadway right-of-way at no cost to the City. The developers have no immediate plans for development; however, they have agreed to assessments on a deferred basis against the property based on normal development policy (Sections IV, V and VIII) for an interior street. The six parcels mentioned above range in size from 3.235 to 10 acres, and are vacant and undeveloped. Based on Council guidance, the required roadway right-of-way was purchased by the City and the proposed assessments against these parcels are also based on development policy. The staff has retained an Independent Land Appraiser to determine the enhancement to each parcel as a result of the roadway improvements. Should the enhancement be less than the proposed assessment, the lesser amount will be recommended to the City Council at the benefit hearing. Should the City Council approve the proposed changes to the development policy, within the next 90 days, which may further reduce assessments against adjacent property, the staff recommends further reduction of assessments be considered, for this project only, at that time. Deferred Payments The deferred provision provides for assessments to be payable in 10 equal installments, each equal to one-tenth of the total amount of the assessment. The first installment shall be due and payable 30 days after completion and acceptance of the project by the City. The remaining 9 equal annual installments, each in the amount of one-tenth of the total assessment, together with interest on the unpaid balance calculated at 8% per annum, with principal and interest payable on the anniversary date of the initial payment. Assessments may be prepaid at any time without penalty. Based on the above, it is proposed that approximately $684,282.78 will bel assessed against property adjacent to Brentwood Stair Road, Units I and II-A, which includes developer cost of the bridge, Unit II-B. Funding will be provided for by a bond fund transfer from the "Revolving Fund Unspecified". City Cost Cost to the City for construction is approximately $256,218.14 (includes City's portion of cost of bridge, Unit II-B), plus $75,240.07 (8%) engineering. Estimated right-of-way acquisition cost to the City is $57,000. Sufficient funds are available in the project account for the City's construction and right-of-way cost.
