HomeMy WebLinkAboutOrdinance 18072-04-2008Ordinance No. 18072-04-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE NEW EQUIl'MENT PURCHASES FUND IN THE AMOUNT OF $2,369,060.00 FROM THE CITY'S EQUIPMENT NOTE PROGRAM FOR TIC PURPOSE OF PURCHASING FOUR NEW ROSENBAUER GENERAL SAFETY PUMP TRUCK FIRE APPARATUS USING A COOPERATIVE CONTRACT THROUGH HOUSTON- GALVESTON AREA COUNCIL (HGAC) WITH EMERGENCY VEHICLES OF TEXAS FOR THE FIRE DEPARTMENT; PROVIDING A SEVERABILITY CLAUSE MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the New Equipment Purchases Fund in the amount of $2,369,060.00 from the Gity's Equipment Note Program for the purpose of purchasing four new Rosenbauer General Safety Pump Truck Fire Apparatus using a cooperative contract through Houston-Galveston Area Council (HGAC) with Emergency Vehicles of Texas for the Fire Department. SECTION 2. That should any portion, section or part of a section of this severability clause be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Authorize the purchase of Four New Rosenbauer General Safety pump truck fire apparatus using a cooperative contract through Houston-Galveston Area Council (HGAC) with Emergency Vehicles of Texas for the Fire Department for a cost not to exceed $2,369,060.00, with payments due within 30 days of receipt of the invoices; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the New Equipment Purchase Fund by $2,369,060.00 to be obtained through the City's Equipment Note program approved by City Council on March 30, 2004, (M&C C-20013) by Ordinance No. 13954. DISCUSSION: This recommendation is for the purchase of four new Rosenbauer General Safety pump truck fire apparatus using HGAC Cooperative Contract FS12-05 with Emergency Vehicles of Texas for the Fire Department. One of the apparatus is an addition to the City's fleet for the new Fire Station 11 located at 1900 Texan Drive and Farm Road 156 and the three remaining apparatus are replacements for units that can no longer be economically maintained and which will be sold at auction. The apparatus will be used by firefighters to transport personnel and equipment to fires, hazardous incidents and other emergency situations. The Fire and Equipment Services Departments have reviewed the pricing and find the costs to be competitive. State law provides that a local government purchasing an item under a cooperative purchasing agreement satisfies state laws requiring that the local government seek competitive bids for purchase of the item. HGAC contracts have been competitively bid to increase and simplify the purchasing power of local government entities across the State of Texas. The Equipment Notes Program, which is being used to purchase these units, has been the traditional financial vehicle for funding this type of special equipment. The City has contracts in place with two banks to purchase equipment notes, which can be used to provide appropriation authority without actually having to sell equipment notes at this time. Upon completion of the FY 2006 Comprehensive Annual Financial Report, the City anticipates selling equipment notes and replenishing the note authority. This practice is similar to the commercial paper program used by the City for larger capital projects.
