HomeMy WebLinkAboutOrdinance 22419-09-2016 ORDINANCE NO. 22419-09-2016 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL DONATIONS CAPITAL PROJECTS FUND IN THE AMOUNT OF$40,000.00 FOR THE PURPOSE OF FUNDING THE CONSTRUCTION OF TWO PERMANENT PORTABLE TOILET ENCLOSURES IN TRINITY PARK; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Donations Capital Projects Fund in the amount of $40,000.00 for the purpose of funding the construction of two permanent portable toilet enclosures in Trinity Park. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize acceptance of funding in the amount of$40,000.00 from Mayfest, Inc., for construction of two permanent portable toilet enclosures in Trinity Park; and 2. Adopt appropriation ordinance increasing estimated receipts and appropriations in the Special Donations Capital Projects Fund in the amount of$40,000.00 for the project. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to accept funding in the amount of $40,000.00 from Mayfest, Inc. (Mayfest) for two permanent portable toilet enclosures at Trinity Park . Since 1973, the City has allowed a portion of Trinity Park to be used for the annual Mayfest event. In 1994, the City and Mayfest entered into a License Agreement with an initial term of five years and two five-year renewal periods. On April 28, 2009, (M&C C-23491) City Council authorized the renewal of this License Agreement. On March 8, 2011, (M&C C-24777) City Council authorized an amendment to the fee structure with Mayfest, modifying the structure from 20 percent of net operating profits to a fixed annual amount of$25,000.00 plus 10 percent of net profits. In May 2016, the Park and Recreation Department (PARD) submitted a proposal to Mayfest encompassing three separate project requests, including the following: 1. Construction of three permanent portable toilet enclosures within Trinity park at $20,000.00 each for a total request of$60,000.00; 2. Continuation of a summer internship program for 2017 to allow a college level student to create an electronic filing system of capital projects for$5,656.00; and 3. Installation of additional solar trash and recycling compactors throughout the park system at $7,000.00 per unit. On July 25, 2016, Mayfest notified the Park and Recreation Department (PARD) that $40,000.00 would be awarded for the construction of two permanent portable toilet enclosures in Trinity Park, paid on a reimbursement basis once the construction contract is awarded. Each structure will consist of a concrete slab, split face CMU block walls, steel gates and a decorative steel roof structure. Although funding for Logname: 80FUNDING FROM MAYFEST INC 2016 Page 1 of 2 only two enclosures is available at this time, it is the Park and Recreation Department (PARD's) long-term plan to ultimately secure funding for up to eight total units to be strategically placed within Trinity Park with the potential for expansion to Forest Park, as well. The Park and Recreation Advisory Board endorsed acceptance of this funding at their August 24, 2016 meeting. Trinity Park is located in COUNCIL DISTRICT 9. This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that the Park and Recreation Department will have the responsibility for collection and validation of these funds. Upon approval of the above recommendations, funds will exist in the Special Donations Capital Projects Fund as outlined above.
