S. ROSS ADDI- TION, NORTH TO CHURCH STREET; AND THE 20-FOOT WIDE ALLEY IN BLOCK 4, D. S. ROSS ADDITION, FROM MALCOLM STREET EAST TO HAYNIE STREET; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. \ B~ IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the below described street and alley rights-of-way be and the same are vacated, abandoned and permanently closed as rights- of-way for street and alley purposes: A. The 6350 Block of Kerr Street, being of variable length and width, and extending from Haynie Street west to Lancaster Avenue; B. The 13-foot wide north/south alley extending from the south boundary line of Lots 5 and 9, Block 4, D. S. Ross Addition, north to the south right-of-way line of Church Street; C. The 20-foot wide east/west alley in Block 4, D S. Ross Addition, extending from the east right-of-way line of Malcolm Street east to the west right-of-way line of Haynie Street. SECTION 2. That the fee to the lands in the above described vacated street and alley rights-of-way is hereby released and shall revert to the adjacent owners, as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities in the above-vacated right-of-way in the 6350 Block of Kerr Street. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. G Jennings Survey, Tract 24(V-80-56) IO Mr. John E. Taylor and Ms Joyce C. Taylor, with the consent of all other abutting property owners, have requested that the City vacate the following (1) The 6350 block of Kerr Street a variable length and width, from Haynie Street, west to Lancaster Avenue, (2) Thee 13' wide north/south alley from the south boundary line of Lots 5 and 9, Slack 4, D S Ross Addition, north to Church Street, and (3) The 20' wide east/west alley in Block 4, D S. Ross Addition, from Malcolm Street east to Haynie Street, all as shown on the attached map The subject street and alley rights-of -way, acquired by dedication, are open on the ground. The subject street is improved, in use, and contains utility facili- ties, the subject alleys are unimproved and contain no utility facilities The subject vacation request is made in order to replat the vacated rights-of-way with abutting property to expand the building area and provide more usable yard space. Reviewing City departments and private utility companies: have raised no object- ions to this request, provided the vacated rights-of-way are replatted with adjacent property and the vacated Kerr Street right-of-way is retained as a utility easement. A satisfactory replat has been submitted The Plan Commission has reviewed this request and recommends that the subject street and alley rights-of-way be vacated as requested Recommendation It is recommended that an Ordinance be adopted vacating the 6350 block of Kerr Street and the 13' wide and 20' wide alleys in Block 4, D S.
