HomeMy WebLinkAboutOrdinance 8708~, ORDINANCE g AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE, ORDINANCE NO. 3011, AS AMENDED, SAME BEING AN ORDINANCE REGULATING AND RESTRICTING THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION, AND FOR SUCH PURPOSES DIVIDING THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS AND SHOWING SUCH DISTRICT AND THE BOUNDARIES THEREOF UPON "DISTRICT MAPS," PROVIDING FOR INTERPRETATION, PURPOSE AND CONFLICT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENAL CLAUSE; AND NAMING AN EFFECTIVE DATE.. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That Ordinance No. 3011 be and is hereby amended so that permitted uses in the hereinafter described area be altered, changed, and amended as follows: Z-82-161 Being a 13.93 acre tract of land situated in the Rueben Burnett Survey, Abstract Number 1922, Tarrant County, Texas, said tract being a portion of that certain tract of land as described by deed to Crawford O. Edwards, deceased, and recorded in Volume 1129, Page 620, Tarrant County Deed Records, and being more particularly described by metes and bounds as follows: BEGINNING at a 5/8 inch iron pin (found), at the southeast corner of Lot 1, Block 19, Overton South Addition, an addition to the City of Fort Worth, as recorded in Plat Volume 388/143, Pge 20, said Deed Records, and being in the westerly right-of-way line of Hulen Street (a 120.0 foot wide public right-of-way) and the beginning of a non-tangent curve to the right whose radius is 2462.52 and whose long ,~ chord bears S 16° 23' 22" West, 867.37 feet; THENCE along said non-tangent curve and along said westerly right-of-way line of Hulen Street, in a southwesterly direction through a central angle of 20° 17' 13", an arc length of 871.91 feet to a 3/8 inch iron pin (found); THENCE South 26° 32' West, 571.29 feet continuing along said westerly right-of-way line of Hulen Street, to the beginning of a curve to the right whose radius is 1000.04 feet and whose long chord bears South 29° OS' 30" West, 89.27 feet; THENCE along said curve and continuing along said westerly right-of-way line of Hulen Street, in a southwesterly direction through a central angle of 05° 06' 59", an arc length of 89.30 feet to a 5/8 inch iron pin (set) with a plastic cap stamped "Carter & Burgess"; - 2- Z-82-161 cont.... THENCE North 46° 30' West, leaving said westerly right-of-way line of Hulen Street, 66.70 feet to a 5/S inch iron pin (set) with a plastic cap stamped "Carter & Burgess" at the beginning of a curve to the right whose radius is 344.00 feet and whose long chord bears North 22° 10' 37" West, 283.38 feet; THENCE along said curve in a northwesterly direction through a central angle of 48° 38' 47", an arc length of 292.07 feet to a 5/8 inch iron pin (set) with a plastic cap stamped "Carter & Burgess"; THENCE North 02° 08' 47" East, 449.44 feet to a 5/8 inch iron pin (set) with a plastic cap stamped "Carter & Burgess", at the beginning of a curve to the right whose radius is 444.0 feet and whose long chord bears North 13° 20' 28" East, 172.40 feet; THENCE along said curve in a northeasterly direction through a central angle of 22° 23' 22", an arc length of 173.50 feet, to a 5/8 inch iron pin (set) with a plastic cap stamped "Carter & Burgess"; THENCE North 24° 32' 09" East, 80.00 feet, to a 5/8 inch iron pin (set) with a plastic cap stamped "Carter & Burgess", at the beginning of a curve to the left whose radius is 556.00 feet and whose long chord bears North Ol° O1' 24" East, 443.63 feet; THENCE along said curve in a northwesterly direction through a central angle of 47° O1' 30", an arc length of 456.33 feet to a 5/8 inch iron pin (set) with a plastic cap stamped "Carter & Burgess"; THENCE South 88° 04' East, at 31.29 feet to a 5/8 inch iron pin (found) for the southwest corner of the aforementioned Lot 1, Block 19, and continuing on with same bearing in all a total distance of 601.29 feet, to the POINT OF BEGINNING and containing 13.93 acres of land, more or less. Edwards, deceased, and being more particularly described by metes and bounds as follows: BEGINNING at the intersection of the north right-of-way line of Oakmont Parkway (a 120.0 foot wide public right-of-way) as described by deeds in Volume 6858, Page 1021 and Volume 6768, Page 1406, said Deed Records, 60.0 foot north of and parallel to the south line of said Jerry Burnett Survey and the west right-of-way line of Hulen Street (a 120.0 foot wide Public right-of-way) as described by deed in Plat Volume 388/62, Page 22, said Deed Records; THENCE North 89° 58' West, 60.0 feet north of and parallel to the south line of said Jerry Burnett Survey, 550.0 feet; ~% ~. -3- Z-82-162 cont... THENCE North 00° 02' East, 552.66 feet; THENCE North 73° 18' 10" East, 558.12 feet to the beginning of a non-tangent curve to the left whose radius is 469.00 feet and whose long chord bears South 39° 10' 12" East, 119.67 feet; THENCE along said non-tangent curve to the left in a southeasterly direction through a central angle of 14° 39' 36" , an arc length of 120.00 feet to the end of said curve; THENCE South 46° 30' 00" East, 100.67 feet to a point on the west right-of-way line of the aforementioned Hulen Street, at the beginning of a non-tangent curve to the left whose radius is 1264.80 feet and whose long chord bears South 13° 36' 56" West, 567.20 feet; THENCE along said non-tangent curve and along the west right-of-way line of said Hu1en Street in a southwesterly direction through a central angle of 25° 54' 52", an arc length of 572.06 feet to the POINT OF BEGINNING and containing 8.78 acres of land, more or less; (Northwest Corner of Hulen Street and Oakmont Boulevard) From Annexed Area to "F" Commercial SECTION 2. That the zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public requirements. They have been made after a full and completepublic hearing, with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of building and encouraging the most appropriate use of land throughout the community. SECTION 3. That this ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of such ordinances, except in those instances where provisions of such ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations or Ordinance No. 3011 or of any amendments thereto of said City of Fort Worth, Texas, that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations, the court shall have all of the powers which existed prior to the effective date of this ordinance. rf *„ ..r; -4- SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6. That any person, firm or corporation who violates. disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five Dollars ($5.00), nor more than Two Hundred Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate,., offense. SECTION 7. That this ordinance shall become effective and be in full force and effect from and after the date of its passage and publications, as recyuired by law, and it is so ordained.
