AMENDMENT NO. 3 STATE OF TEXAS § CITY SECRETARY CONTRACT NO. 28226 (No M&C needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Carter & Burgess, Inc., (Engineer) made and entered into City Secretary Contract No. 28226 (the Contract) which was authorized by the City Council by M&C C-19345 on the 11th day of November, 2002. This contract was previously revised by Amendment No. 1 for $8,900.00; and by Amendment No. 2 for$102,248.00; WHEREAS, the Contract involves engineering services for the following project: Engineering Contract for Relocation of approximately 1,700 linear feet of 54" Sanitary Sewer Mains (M-272B) and (M-15R) in an area bounded by Forest Park Boulevard, the Clear Fork of the Trinity River' Henderson Street in the Central Business District of Fort Worth, Texas. WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated January 5, 2005, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $8,300.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum $230,517.00. 3. Please note this amendment does not include any additional M/WBE participation. Creating 2 Phases of construction for this contract Per the city's request, this contract was split up into two separate phases. This requires attendance at separate pre-bid and pre-construction meetings. It also requires two separate sets of construction documents to be prepared. We realize we did this work some time ago, and don't feel that this effort was significant to warrant a request for additional services on its own, but with all of the other changes we are making to the construction documents we feel it is worth mentioning. Preparation of addenda This task included; obtain specification for pipe material testing and modify to include in contract documents, coordination with testing lab to obtain proposal for pipe material testing, obtain specification for ductile iron pipe coating and modify it for this project. Distribute addendum to plan holders. We subsequently prepared a third addendum, per your request, to revise some of the language regarding the pipe material testing specification. And, we will issue a forth addendum to include the Traffic Control Plan that we are currently working on. Revisions to structural design to accommodate different pipe material options We made revisions to the structural plans to accommodate the additional pipe materials.
