ORDINANCE NO. ~~
AN ORDINANCE AMENDING SECTION 37-25(b) AND
SECTION 37-26(a), OF CHAPTER 37 OF THE CODE OF
THE CITY OF FORT WORTH (1964), AS AMENDED, BY
REVISING CERTAIN WATER RATES AND CHARGES; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;
REPEALING ALL ORDINANCES AND PROVISIONS OF THE
CODE OF THE CITY OF FORT WORTH IN CONFLICT HERE-
WITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 37-25(b) of Chapter 37 of the Code of the City of
Fort Worth (1964), as amended, be and is hereby amended and, after
having been so amended, shall hereafter read and be as follows:
"(b) The following schedule of rates per month, or
fraction thereof, shall b e the charges to all persons, as
herein defined, for furnishing water to water customers
located within the City:
RATE FOR WATER SERVICE
Monthly Service Charge for Water
A monthly service charge in the following amount
shall be charged based on the size of the meter serving
the customer:

"The service charges set out in the foregoing sche-
dule are based upon the amount of water used as measured
by meters. "
SECTION 2.
That "Schedule A" of Section 37-26(a), Connection Charge, of
Chapter 37 of the Fort Worth City Code (1964), as amended, be and
the same is hereby amended and, after having been so amended,
"Schedule A" shall hereafter read and be as follows:

SECTION 3.
That this ordinance shall repeal every prior ordinance and pro-
vision of the Fort Worth City Code in conflict herewith but only
insofar as any portion of such prior ordinance or provision shall be
in conflict, and as to all other ordinances or provisions of the
Fort Worth City Code not in direct conflict herewith, this ordinance
shall b e and is hereby made cumulative.
SECTION 4.
That all rights or remedies of the City of Fort Worth, Texas,
are expressly saved as to any and all violations of Chapter 37 or of

any amendments thereto, of the Fort Worth City Code (1964), as
amended, which have accrued at the time of the effective date of
this ordinance; and as to such accrued violations, the Court shall
have all of the powers that existed prior to the effective date of
this ordinance.
SECTION 5.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such un-
constitutional phrase, clause, sentence, paragraph or section.
SECTION 6.
That this ordinance shall become effective and be in full force
and effect from and after its passage, provided, however, that the
increased rates specified herein shall apply to customer utility
statements sent by the City of Fort Worth on or after October 1,
1982, and it is so ordained.

On June 11, 1980, the Consultant Engineering firm of Black and Veatch submitted
RRANSPORr ri~N~~gb~,bat~i~a water rate study for Fort Worth, The study projected the need for
water rate increases in fiscal years 1981, 1982 and 1983 Rates were increased
a~~,~:kr.,;,;: „`,~ ,O,ctober, 1980 and 1981, after review of cost projections.
The cost of maintenance, operation and debt service have continued to increase
and the following table indicates various expenditure areas where these costs
have been significant.

It should be noted that raw water costs for 1982-83 anticipate settlement of the
~.~.._ raw water contract dispute with the City of Arlington and adoption of rates
---- included in the Settlement Agreement. Also, a decrease is expected in Water
-""~" - Treatment Plant expenses between 1981-82 and 1982-83, due to flood flow conditions
~~~`~" `which increased the turbidities in the raw water which required great quantities
__~~ of chemicals to remove mud
Proposed Rate Adjustments
The increasing costs of energy, materials, equipment and manpower require that
the Water Department derive funds in excess of those that can be collected under
the existing water rate structures. It is proposed that a rate adjustment be
adopted, and that the use of a summer rate and the normal rate be continued..
An overall 15 percent increase in the water rates is proposed C~ ~ ~(~~~

Attachment I is a li sting of monthly charges for different levels of water use
to provide a compari son of the impact of the proposed rate on customers
The increased costs of providing water to Fort Worth citizens make it necessary
to increase rates to provide adequate service and safe, potable water
Recommendations
It is recommended th at:
1) The Water rate s chedule as outlined above be approved as the rates to be charg
all customers of the Fort Worth Water Utility Department, and,
2) The City Council adopt the attached ordinance adopting the rate schedule
outlined above w ith an effective date of billing on and after Octobex--~
