HomeMy WebLinkAboutOrdinance 9029 ORDINANCE NO. < ' AN ORDINANCE AMENDING CHAPTER 29A (POLICE) OF THE CODE OF THE CITY OF FORT WORTH (1964), AS AMENDED,&Y REVISING ARTICLE III, SECTION 29A-12(e) TO PERMIT THE CITY OF FORT WORTH TO AGREE NOT TO REQUEST REIMBURSEMENT FOR LAW ENFORCEMENT SERVICES REN- DERED TO OTHER COUNTIES AND MUNICIPALITIES PURSUANT TO AN INTERLOCAL ASSISTANCE AGREEMENT; PROVIDING FOR THE REPEAL OF ALL ORDINANCES AND PROVISIONS IN CONFLICT HEREWITH AND MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES NOT IN CONFLICT; PRO- VIDING A SEVERABILITY CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Chapter 29A (Police), Article III of the Code of the City of Fort Worth (1964), as amended, is hereby amended by changing Section 29A-12(e) to read as follows: "(e) Unless otherwise expressly agreed to by the City of Fort Worth pursuant to a law enforcement interlocal assistance agreement duly executed by the City of Fort Worth and other counties or municipalities, all wages and pension payments, payments for damage to equipment and clothing, medical expenses and expenses of travel, food, and lodging shall be paid by the City of Fort Worth and shall be reimbursed by the county or municipal- ity whose authorized official requested the services." SECTION 2. This ordinance shall repeal every prior ordinance and provision of the Code of the City of Fort Worth in conflict herewith but only insofar as any portion of such prior ordinance or provision shall be in conflict, and as to all other ordinances or provisions of the Code of the City of Fort Worth not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION.4. This ordinance shall be in full force and effect from and after the date of its passage. Local law enforcement agencies have attempted to address this problem through informal cooperation and periodic meetings to exchange information. As a result of these meetings, it is now proposed that a formalized interlocal assistance group be established, to be titled the Greater Dallas-Fort Worth Regional Law Enforcement Task Force. As stated in the Interlocal Agreement, "The purpose of the Task Force is to cooperate in the investigation of criminal activity and enforcement of the laws of the state, and to assist in providing additional law enforcement officers to protect health, life and property again riot, unlawful assembly characterized by the use of force and violence, and during times of natural disasters of man-made calamity." According to the terms of the agreement, a member may request assistance from another member agency, and the request shall include the number of personnel needed, type of equipment required and the location where the assistance is needed. The level of response provided is subject to the discretion of the chief law enforcement officer of the responding agency. The officers responding to a request shall be under the command of the requesting agency and shall have all the powers of a regular law enforcement officer of that jurisdiction. Officers responding to a request for assistance shall receive the same salary and benefits they regularly receive from the agency they are employed by. Every law enforcement agency within the greater Dallas-Fort Worth area that executes the Interlocal Agreement will be a member of the Task Force with all rights, privileges and responsibilities contained within the agreement. In order to participate in the Greater Dallas-Fort Worth Regional Law Enforcement Task Force, it will be necessary to amend Chapter 29A (Police) , Article III of the City Code of Fort Worth (1964) , as amended, to change Section 29A-12(e) to state the all reimbursement for services performed to a member of the Task Force will be waived.
