HomeMy WebLinkAboutOrdinance 9329 ORDINANCE NO. 3 � AN ORDINANCE INCREASING BY $10,542 THE ESTIMATED REVENUES ACCRUING TO THE GENERAL FUND OF THE CITY OF FORT WORTH FOR FISCAL YEAR 1984-1985, SAID SUM BEING DONATED BY THE FORT WORTH GARDEN CENTER, INC. , AND APPROPRIATING FROM THE INCREASED ESTIMATED REVENUES OF THE GENERAL FUND THE SUM OF $10,542 TO PARKS AND RECREATION DEPARTMENT ACCOUNT NO. 80-20-60 FOR THE PURPOSE OF FUNDING THE SALARY OF ONE GARDENER II POSITION AT THE BOTANIC GARDEN; PROVIDING A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the estimated revenues accruing to the General Fund of the City of Fort Worth for the fiscal year 1984-1985 are hereby in- creased by $10,542.00, said sum being donated by Fort Worth Garden Center, Inc. , to the City of Fort Worth; and that in addition to those amounts allocated to the various City departments and programs for the fiscal year 1984-1985 by virtue of Ordinance No. 9168, and supplemental appropriations, and in the budget of the City Manager, there is hereby appropriated from the increased estimated revenues of the General Fund the sum of $10,542.00, said sum to be trans- ferred to Park and Recreation Account No. 80-20-60 for the purpose of funding the salary of one Gardener II position at the Fort Worth Botanic Garden. SECTION 2. That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1964) , as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of a this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the city Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Section 1 in the minutes of the City Council and by filing this ordinance in the ordinance records of the City. SECTION 5. That this ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. As this gift was not included in either the 1984-85 estimated budget revenue or appropriations, Council action is required to appropriate these funds for their intended purpose. The Park and Recreation Advisory Board thanked the Fort Worth Garden Center, Inc. for this gift and voted to recommend acceptance of the gift and adoption of the related appropriation ordinance. Recommendations It is recommended that City Council: 1. Accept the gift in the amount of $10,542; and 2. Adopt a supplemental appropriations ordinance appropriating $10,542 from increased estimated budgeted revenues of the General Fund to the Parks and Recreation Department Account No. 80-20-60 for the purpose of funding 100% of the salary of one Gardener II position (including fringe benefits) at the Botanic Garden.
