AN ORDINANCE AMENDING CHAPTER 40, "DEPARTMENT OF PUBLIC
LIBRARIES," OF THE CODE OF THE CITY OF FORT WORTH, TEXAS
(1964) , AS AMENDED, BY CHANGING CERTAIN FEES CHARGED TO
NON-RESIDENT USERS OF THE FORT WORTH PUBLIC LIBRARY; PRO-
VIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE AND REPEAL-
ING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR A
SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLL-
MENT; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1 .
That Section 40-11 of Chapter 40, "Department of Public
Libraries," of the Code of the City of Fort Worth (1964) , as
amended, be hereby further amended and that, after such amendment,
the said Section 40-11 of Chapter 40 shall read as follows:
"Sec. 40-11 . Fees for certain nonresident users.
"(a) Nonresident users of Fort Worth Public Library
materials and services shall be assessed a fee for
such use, which shall entitle nonresident individuals
or institutions to borrow library materials or use
other library services, according to the following
fee and usage level schedule, to wit:

(b) Definitions: For purposes of this section, the
following definitions shall apply:
(1) 'Nonresident. ' An individual or institution
who or which does not reside within or have
its offices within the corporate limits of
the City of Fort Worth.
Exception: An individual or institution who
or which owns property located within the
corporate limits of the City of Fort Worth
shall be exempted from the payment of non-
resident user fees for library use.
(2) 'Nonresident Student. ' A nonresident who
is enrolled in any formally recognized
educational institution, subject to verifi-
cation of such status by the Fort Worth
Public Library.
(3) 'Nonresident Donor. ' A nonresident who has
donated Five Hundred Dollars ($500.00) or
more to the Fort Worth Public Library.
Cards issued to donors will be valid for
twelve (12) months following the date the
donation is received.
(4) 'Nonresident Volunteer. ' A nonresident who
has completed at least 100 hours of volun-
teer service to the Fort Worth Public
Library as a participant in the VALUE vol-
unteer program. Cards issued will be valid
for one (1 ) year. Cards may be renewed when
100 additional hours of service are com-
pleted.
(5) 'Library materials. ' Any book, pamphlet,
periodical, paper, sound recording, film
videocassette or other property which is
subject to removal from the library through
the customary check-out procedure of such
library.
(6) 'Library services. ' Services shall include
but not be limited to use of conference
rooms, meeting rooms and auditorium facil-
ities and library tours and programs.
(c) Payment of nonresident user fees shall not pre-
clude payment of any regularly assessed fees which
may be required for the use of library facilities or
materials.
(d) Nonresident status and other policies regarding
this Section shall be determined according to pro-
cedures established by the Fort Worth Public
Library."
SECTION 2.
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas (1964) , as

amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and
Sections 1 and 5 in the minutes of the City Council and by filing
the ordinance in the ordinance records of the City.
SECTION 5.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

Recommendation
It is recommended that the City Council adopt an ordinance amending Chapter 40,
"Libraries," of the City Code, authorizing the Library to issue a library card
for non-resident students for a $15 annual fee; a one-year card to non-resident
volunteers who have donated 100 or more hours in the Library; and a one-year card
to monetary donors who have contributed $500 or more. The effective date of im-
plementation will be January 2, 1986.
Background
May 1, 1985, the Fort Worth Public Library began charging patrons who live out-
side of the City limits or who do not own City property a fee to borrow library
materials.
Some non-residents annually donate many hours of volunteer time and/or monetary
gifts to the Library. These persons must now pay the regular fees for a non-
resident borrower's card to check out library materials . Exceptions should be
made for in-kind privileges to these Library supporters .
There also have been substantial requests for another means of allowing library
borrowing by the students who reside outside the City of Fort Worth. Recognizing
the future impact of a well-educated labor force and the significant number of
requests for access to the Library, a student card based on the annual per capi-
ta cost of the Fort Worth Public Library is recommended.
All other non-resident fee cards will remain as previously approved by Council .
