AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING THE UTILITY EASEMENT DESCRIBED MORE SPECIFICALLY
HEREIN, SAID UTILITY EASEMENT LYING WITHIN FOSSIL CREEK,
PHASE I, SECTIONS 1 AND 2, OF THE CITY OF FORT WORTH ;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS :
SECTION 1 .
THAT THE utility easement described more specifically in
Exhibit "A" attached hereto and incorporated herein by reference for
all purposes , located within Fossil Creek, Phase I, Sections 1 and
2, Addition to the City of Fort Worth, be and the same is vacated,
abandoned, and permanently closed and extinguished.
SECTION 2.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed .
SECTION 3.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

BEING a 0.0904 Acre tract of land out of Lots 1R and 2R of Block 2,of Fossil
Creek Phase I, Section 1 as recorded in Volume 388-205, Page 70 and Lot 3A
of Block 2, of Fossil Creek Phase I, Section 2 as recorded in Volume 388-
206, Page 25 of the Plat Records of Tarrant County, Texas, and being more
particularly described as follows:
COMMENCING at an iron rod at the Southeast Corner of said Lot 1R of Bloc; 2,
said iron rod also being on the West right-of-way line of Stratum Drive (a
60-foot wide right-of-way):
THENCE North 89 degrees 55 minutes 11 seconds West along the South Line of
said Lot 1R of Block 2 a distance of 12.00 feet to the POINT OF BEGINNING;
THENCE North 89 degrees 55 minutes 11 seconds West along the south lines of
said Lot 1R of Block 2 and Lot 3A of Block 2, at 248.00 feet passing an iron
rod found at the Southwest corner of said Lot 1R and the Southeast corner of
said Lot 3A, continuing in all a total distance of 253.00 feet to a point
for corner;
THENCE North 00 degrees 04 minutes 49 seconds East along a line 5.00 feet
perpendicularly west of and parallel to the West line of said Lot iR of
Block 2 and the East line of said Lots 2R and 3A of Block 2, at 199. 75 feet
passing the South line of Lot 2R same being the North line of Lot 3A,
continuing in all a total distance of 539.75 feet to a point for corner
which is 10.00 feet perpendicularly south of the South right-of-way line of
Fossil Creek Boulevard (a 120 foot wide right-of-way at this point) ;
THENCE South 89 degrees 58 minutes 30 seconds East along a line 10.00 feet
perpendicularly south of the South right-of-way line of Fossil Creek
Boulevard a distance of 5.00 feet to a point on the East line of said Lot 2R
of Block 2 and the West line of said Lot 1R of Block 2;
THENCE South 00 degrees 04 minutes 49 seconds West along the West line of
said Lot 1R of Block 2 and the East lines of Lots 2R and 3A of Block 2, at
340.00 feet passing the Northeast corner of said Lot 3A and the Southeast
corner of said Lot 2R, containing in all a total distance of 534.75 feet to
a point for corner;
THENCE South 89 degrees 55 minutes 11 seconds East along a line 5.00 feet
perpendicularly north of and parallel to the South Line of said Lot 1R a
distance of 248.00 feet to a point;
THENCE South 00 degrees 04 minutes 49 seconds West a distance of 5.00 feet

RECOMMENDATION
It is recommended that the City Council adopt an ordinance vacating a 5' wide
utility easement located along and adjacent to the south property line (5' X
260' ) of Lot 1R, Block 2, Fossil Creek, Phase I, Section 1 , as recorded in Volume
388-205, Page 70, P.R.T.C.T. and a 5' wide utility easement located along and
adjacent to the east property line of Lot 2R, Block 2, Fossil Creek, Phase I ,
Section 1 , as recorded in Volume 388-205, Page 70, P.R.T.C.T. and also along and
adjacent to the east property line of Lot 3A, Block 2, Fossil Creek, Phase I ,
Section 2 (5 ' X 549.75' ) , as recorded in Volume 388-206, Page 25, P.R.T.C.T.
DISCUSSION
Messrs. Joe W. Edge, Hunt Realty Corporation, and NCR Corporation, owners of
abutting property, have requested that the City vacate the above described
utility easements, as shown on the attached map.
The subject easements , acquired by dedication, are platted but contain no utility
facilities. The subject vacation request is made in order to utilize the vacated
easements as part of the subject property, thus expanding the building area and
providing more usable yard space.
The required and appropriate monetary consideration ($1 .00) has been paid to the
Real Property Department , as required by the Land Agent for the City of Fort
Worth. Reviewing City departments and private utility companies have raised no
objections to this request.
