HomeMy WebLinkAboutContract 26607 AMENDMENT NO. 4 STATE OF TEXAS $ CITY SECRETARY CONTRACT NO. �Y LFA O (No MSC Needed) COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and Baird, Hampton & Brown, Inc. , (Engineer) made and entered into City Secretary Contract No. 22572, (the Contract) which was authorized by the City Council by MSC C-15934 on the 13th day of March, 1997; and subsequently revised by three previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Sanitary Sewer Rehabilitation Contract HIV (44) . WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated February 71 20011 a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $2,750.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $192,208.49. As you know, the staff at BHB prepared the plan for grading the alley south of this location, and we are confident we can assist you with this project in a timely and professional manner. Our scope is based upon our discussions and the City's desire to extend the temporary grading and crushed limestone paving, south of this alley, northward to Bryce Avenue. Our services will generate a grading plan similar,to the plan provided for the alley from Byers to south of Collinwood. Refer to enclosed drawing. As per the enclosed plan, our design will utilize dated (1996) topographic survey data; this data may not necessarily represent existing conditions or the actual quantity of required unclassified excavation. Services not included in the above scope consist of drainage analysis, pavement design, alley profiles, contract documents, and/or surveying. If the City requests services in addition to preparation of a grading plan, such effort will be considered additional scope. We propose to prepare the above described drawing for a total fixed fee amount of Two Thousand Seven Hundred and Fifty ($2,750) Dollars. This fee provides Twenty Five Dollars for reproduction and direct expenses; additional direct costs (for reproduction, shipping/courier, mileage, etc) will be billed at cost plus ten percent. Reproduction, for other than review sets of plans, is not included; the final documents will be provided in reproducible vellum. Electronic files (in AutoCAD R14) of the site drawings will be made available upon request. We propose to prepare a substantially complete plan, for review and comment, within approximately two weeks of receiving your authorization to proceed. Services under this proposal will be performed in a manner consistent with that level of care and skill ordinarily exercised by members of this profession currently practicing in the same locality under similar conditions. No other representation, expressed or implied, and no warranty or guarantee is included or intended in this proposal, or in any report, opinion, document, etc. prepared by Baird, Hampton & Brown, Inc. In order to provide a fee which includes a lesser allowance for risk funding, the liability arising from professional acts, errors or omissions, will be limited such that the total aggregate liability will not exceed $100,000 or the total proposed fee for the services rendered on this project, whichever is higher. If the above described scope of services, schedule and fee structure meets with your approval then please sign below signifying your acceptance of our proposal and return a copy to us for our files. We will submit monthly invoices, requesting progress payment based upon the project's level of completion. Payment is due upon receipt; late payments (over 30 days) will be subject to interest charges at prime plus two percent.
