HomeMy WebLinkAboutOrdinance 8532e ~~ ORDINANCE N0, ~ s ~ ~~ ~"' ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF NW ~36TN STREET AND PORTIONS OF SUNDRY OTHE~t STREETS, AVENUES AND PUELYC PLACES IN THE CTTY OF FORT WORTH, TEXASa DECLARING THE CONTRACT WITH AUSTIN ROAD COMPANY FoR THE CONSTRUCTION oI" SAID YMPROVEMENTS FULLY COMPLETED AND PERFORMEDe DYRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTYFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GYVYNG EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAYNST SO1~ OF SAID ASSESSMENTS; DIRECTYNG THE CITY SECRETARY TO ENGROSS AND ENROLL THYS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE EOOR OF TI~YE CITY COUNCIL OF FORT WORTH, TEXAS, AND RY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SA YD CITYg AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Austin Road Company , for the maleing and construction of certain street improvements on the hereinafter described portions of streets, avenues and pubbic places in said City, tom~iit: NW 36TH STREET From North Main Street to Ross Avenue, known and designated as Project No. 021-28277, a one and one-half inch thick hot- mix asphaltic concrete pavement on a three and one-half inch thick hot-mix asphaltic binder course on a six-inch thick lime treated subgrade,with seven-inch high concrete curb and eighteen-inch wide concrete gutter on a~.thirty-foot roadway. Six-inch thick concrete driveways will be constructed where specified. titiHENEAS, by sundry proceedings heretofore pa3sed by the City Council of the City of Fort Worth, Texas, including Ordinance No, R~4? , a portion of the cast of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, wHEFd~;AS, the City Council of the City of Fort ~'~orth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain cred~.ts against some one or more of the assessments levied by Ordinance No, 8342 , and WHE1~:A3, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in comglete accordance with the contract therefor; NOtiV, 'PHEh~.FORE, BE IN ORDAIIJED I3Y THE CITY COUNCIL OF TtiE CITY OF FORT WORTH, TEXAS, `THAT Ie The improvements on each of the portions of streets, avenues and public: places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments, The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereone The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after diving effect to such credit, if any, are hereby enumerated and itemized as follows: ,~ . ... III, When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract pricem IV, The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City, V.
