UNAPPROPRIATED RETAINED EARNINGS TO THE "GENERAL FUND WATER AND SEWER ACCOUNT NO 60-90-00., SUCH AMOUNT TO BE AVAILABLE `I'O PAY "FINANCIAL CONCEPTS AND APPLICATIONS, INC FOR W ORK PERFORMED REGARDING THE "ARLINGTON RATE CASE" BEFORE THE TEXAS WATER COMMIS- SION; PROVIDING FOR A SEVERABILIT Y CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVID- ING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS; SECTION 1 That the City Manager of the City of Fort Worth is hereby authorized to appropriate $10,000 from the Water and Sewer Unap- a propriated Retained Earnings and transfer it to the "General Fund Water and Sewer Account No 60-90-00, such amount to be available to pay "Financial Concepts and Applications, Inc for work performed regarding the "Arlington Rate Case" before the Texas Water Commission SECTION 2 Should ariy portion, section or part of a section of this Ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections or parts of sections of this Ordinance, which said remaining provisions shall be and remain in full force and effect SECTION 3 That this ordinance shall be cumulative of Ordinance No 8157, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instances said conflicting provisions are hereby expressly repealed ~~, .:~ ~., SECTION 4 .> That this Ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained APPROVED AS TO FORM AND LEGALITY City Attorney Date ~ ~ y , - ~ ~ ADOPTED ~ ' ~' 3' 8~ EFFECTIVE / ~~~' g~ -2- ~~ a§f~~t ~6ti~~~ .tip ~T~F~~~° p.~~zf City of Fort Worth, Texas _ J1~la~or and Council Cornyra.ua~iicatioaa DATE ~~~~~~ ~NUMBERCE ** sue~ECT Additional Appropriation For Rate C lt i li A t W PAGE 1 G-5262 onsu ants n r ng on ater Rate Case ~ 01 On June 30, 1981 (M&C G-5032), the City Council authorized the hiring of FINCAP,Inc a rate consultant, to testify in the City of Arlington Water Rate Case before the Texas Water Commission and appropriated $25,000 from Water and Sewer Unappropriated Retained Earnings to pay for such consultant fees On Noveulber 3, 1981 (MSC G-5141), the City Council authorized an additional $1Oj000, and on January 19, 1982 (M&C G-6110), the City Council authorized an additional $10,000 and set the maximum fee at $45,000 -As_.a,_result of „the extensive review of past water studies of the City and the 'Tar~ant.....County Water Control and Improvement District No 1 and the ~_extens.ive-work--required in the proposed settlement, it is necessary to ~~--r-arse- the maximum fee by $10,000 to $55,000 -~-Re`commendat ~.ons« _~_Lt-. is xecommd that the City Council -, 1) Authorize the City Manager to execute an amendment to the contract with FINCAP, Inc to increase the maximum fee from $45,000 to $55,000; and°, 2) Adopt the attached supplemental appropriation ordinance appropriating $10,000 from Water and Sewer Fund Unappropriated Retained Earnings to Account No 60-90-10 GG j c Attachment ~t'PROVEQ~ ~Y QTY C(~UCit.
