HomeMy WebLinkAboutContract 26641 CITY SECRET CONTRACT NO Y VOICE RADIO AGREEMENT BETWEEN CITY OF FORT WORTH AND THE FORT WORTH TRANSPORTATION AUTHORITY (THE T) The voice radio coverage requirements to meet the area within City of Fort Worth (COFW) jurisdiction boundaries can also provide voice radio coverage for the Fort Worth Transportation Authority (The T). As a result, there are economies-of-scale advantages in entering into an agreement to share the acquisition and maintenance of a state-of the-art electronic infrastructure to support voice radio coverage for both jurisdictions for a twenty-year period defined as the life of the system. Based on the above, and under the auspices of the Interlocal Cooperation Act, Chapter 791, Texas Government Code, The T and COFW enter into a letter of agreement as: 1. Installation and maintenance of the voice radio infrastructure will be the responsibility of the COFW unless otherwise stated in this agreement. 2. The T will initially acquire one radio for use on the radio infrastructure. System initialization for The T will begin when the radio is operational on the system. 3. The COFW will be responsible for reviewing the infrastructure loading. If in the opinion of the COFW, other entities can be added to the system without adversely affecting active participants over the life of the system, the COFW reserves the right to enter into a similar agreement with these entities. 4. The T will pay the COFW a prorated share of the total cost for maintenance of the infrastructure over the life of the system based on the number of radios. First full year estimated cost is $180.00 per radio. First maintenance infrastructure payments will be due and payable at the time of joining the radio system, with succeeding annual maintenance infrastructure payments being due and payable on the anniversary date thereafter. 5. The recurring cost in 4 above will be adjusted annually based on actual costs prorated to the number of users of the system. 6. The T has the right to discontinue use of the infrastructure and/or radio maintenance support with ninety-day's written notice prior to the anniversary date. COFW has the right to remove The T from the infrastructure for failure to make full payment system costs within ninety days after the anniversary date or for misuse of the system such as data transfer on the system. 7. The T will be responsible for all non-infrastructure components of their system such as radios and consoles and for any special equipment interfaced to the infrastructure such as ID decoding equipment to include all costs. 1 8. The City of Fort Worth will provide The T with one (1) mobile and one (1) portable radios of the same type used by the City of Fort Worth for the purpose of testing the radio coverage of the operating area of The T. By signing this The T attests that it agrees that the radio coverage in its operating area is satisfactory. The COFW does not guarantee that radio coverage will be satisfactory. The COFW makes no warranties concerning radio coverage. 9. Telephone interconnect is not available on the Public Safety Trunked Radio System or the Local Government Trunked Radio System and will not be permitted. Private calls for The T will be allowed on the Local Government Trunked Radio System if the system is not adversely affected. 10. The transmission of data communications on the voice radio system will not be allowed. 11. The T is to join the Local Government Trunked Radio System to support their communication requirements. 12. The three (3) 806-821 MHz channels that The T currently uses for communications are to be returned to the City of Fort Worth. The City of Fort Worth is free to do what it wishes with this returned spectrum. The spectrum used by The T is described under the FCC Call Sign KNIY844. In exchange for the spectrum being returned to the City of Fort Worth, the system infrastructure access fee of $600 per radio is being waived. This spectrum was originally licensed to the City of Fort Worth and shall remain licensed by the City of Fort Worth even if The T decides to leave the Local Government Trunked Radio System at some point in the future. Ilp vLtix City of Fort Worth, Texas "alJor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 3/27/01 **C-18509 04RAD10 1 of 1 SUBJECT VOICE RADIO AGREEMENT BETWEEN THE FORT WORTH TRANSPORTATION AUTHORITY AND THE CITY OF FORT WORTH RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute an Interlocal Agreement with the Fort Worth Transportation Authority (The T) allowing them to join the City's Local Government Trunked Radio System. DISCUSSION: The Information Technology Solutions Department negotiated with The T their joining of the Local Government Trunked Radio System. Through the agreement the System Infrastructure Fee, currently $600 per radio, would be waived in exchange for The T returning to the control of the City the three 806-821 MHz frequencies that they currently use. These channels will be added to the Mobile Data System, thereby expanding it to an eight channel solution. The estimated value of the spectrum being returned to the City is at least $3 million (over$1 million per channel). The T will pay the monthly System Access Fee which is currently $15 per month, per device. They have an estimated 300 radios (buses, vehicles, supervisors, consoles, etc.). The T's consoles will be tied into the communication system in a manner similar to that of the City of North Richland Hills and the Tarrant County Sheriff's Office. There are no costs to the City associated with this initiative. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that there are no expenses associated with the execution of this Interlocal Agreement.
