AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE AMOUNT OF $495,066.00, IN THE SEWER CAPITAL FUND, FOR THE
PURPOSE OF FUNDING DESIGN AND WORK TO PROTECT THE 90- AND 96—INCH
SANITARY SEWER MAINS PARALLEL TO THE TRINITY RIVER; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
amount of$495,066.00, in the Sewer Capital Fund, for the purpose of funding Emergency Design and Work
to Protect the 90-and 96—inch Sanitary Sewer Mains Parallel to the Trinity River.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

SUBJECT: TRINITY RIVER STREAMBANK EROSION AFFECTING TWO 90"
SANITARY SEWER LINES—EMERGENCY RESPONSE
Two 90" diameter sanitary sewer lines were installed in the 1960's and 1970's that initially
connected the old Riverside Plant with the Village Creek Plant. They are generally aligned
parallel to and offset from the Trinity River. These two pipelines currently convey the majority
of the wastewater generated in Fort Worth to the Village Creek Plant, with flow capacity of
upwards of 200 million gallons per day. With the recent heavy rains and associated flooding,
approximately 300 linear feet of the Trinity River streambank has eroded to the point that the
existing pipelines are in danger of being exposed and undermined. Should one of these pipelines
start leaking as a result of soil movement or loss of soil support, the wastewater would flow
directly into the Trinity River.
A two part solution is recommended. First,structural piles will be driven to support the pipes in
the event of further flooding and associated erosion. Second, the Trinity River streambank that
has eroded will be stabilized to prevent further erosion. Driving the piles can be performed as
soon as we can get a boring rig and pile driver into the site. Stabilizing the streambank will
require a Corps of Engineers Permit 13, which may take several weeks to obtain, but
construction should be initiated immediately after receipt of the permit.
Waiting to bid and award a contract to support the existing pipelines or stabilize the streambank
is not the best interest of the health and safety of the City of Fort Worth. Chapter 2, Article I,
Section 2-9 of the City's Code of Ordinances and Section 252.022 of the Local Government
Code exempts from normal bidding requirements expenditures that are necessary to preserve or
protect public health or safety of the municipality's residents; and procurements necessary
because of unforeseen damage to public machinery,equipment, or property.
This memo is submitted to request authorization for emergency procurement of engineering and
construction services to support the pipeline and stabilize the Trinity River streambank. It is
estimated that the engineering, permitting, and constru tion costs associated with these
emergency repairs may cost approximately$700,000.(Co,%5 & 463, 5) 1400 ee01^S

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Sewer Capital Fund in the amount of$495,066.00 from available funds; and
2. Ratify an Agreement for Emergency Professional Services with James DeOtte Engineering, Inc., City
Secretary No. 47883 in the final amount of$151,165.00 for emergency design to protect the 90 and 96-
inch sanitary sewer mains located parallel to the Trinity River and ratify an Emergency Agreement with
William J. Schultz, Inc. d/b/a Circle C Construction Company City Secretary No. 47913 and authorize
payment in the final amount of$283,900.65 to William J. Schultz, Inc. d/b/a Circle C Construction
Company for emergency work to install structural sheet piling to protect the 90 and 96-inch sanitary sewer
mains located parallel to the Trinity River.
DISCUSSION:
These two sanitary sewer mains installed in the 1960's and 1970's initially connected the old Riverside
Wastewater Treatment Plant with the Village Creek Wastewater Treatment Plant. Both pipelines are
generally aligned parallel to and offset from the Trinity River. The pipelines convey the majority of the
wastewater generated in Fort Worth to the Village Creek Wastewater Treatment Plant, with peak flow
capacity of upwards of 200 million gallons per day. With the heavy rains and associated flooding in May
and June of this year, approximately 300 linear feet of the Trinity River streambank eroded to the point
that both sanitary sewer pipelines were in danger of being exposed and undermined. If one or both of
these pipelines had leaked as a result of soil movement or loss of soil support, wastewater would have
flowed directly into the Trinity River.
Sanitary Sewer Overflows are a threat to the health and safety of the City of Fort Worth. Chapter 2, Article
I, Section 2-9 of the City's Code of Ordinances and Section 252.022 of the Local Government Code
exempts from normal bidding requirements expenditures that are necessary to preserve or protect public
health or safety of the municipality's residents; and procurements necessary because of unforeseen
damage to public machinery, equipment, or property.

A two part solution was recommended. First, structural piles were driven to support the pipes in the event
of further Flooding and associated erosion. Second, the Trinity River streambank that has eroded will be
permanently stabilized using rock gabion baskets to prevent further erosion. Stabilizing the streambank
will require a Corps for Engineers Permit 13, which may take several months to obtain. The Water
Department engaged James DeOtte Engineering Inc., to provide the engineering design and permitting
services necessary for the structural piles and the permanent streambank stabilization. It is anticipated
that construction of the permanent streambank stabilization improvements will be advertised for bid upon
receipt of the necessary Corps of Engineers Permit, utilizing the city's normal construction procurement
process.
The attached City Manager memo dated June 7, 2016, approved the emergency design, permitting and
construction work. The total fee to prepare the streambank stabilization design and necessary Corps of
Engineers permits was $151,165.00, which is fair and reasonable for the work performed. It was
necessary to drive structural sheet piles at two locations 80 feet along the banks off the river to support
the pipes in the event of future flooding and erosion. It was beyond the City's ability to perform repairs of
this size, length, and depth. The Water Department engaged William J. Schultz, Inc. d/b/a Circle C
Construction Company to perform this emergency pipeline and streambank stabilization work. The total
construction cost to install the sheet piling was $283,900.65, which is fair and reasonable for the work
performed. In addition to the emergency design and construction contract costs, $60,000.00 is required for
ongoing project management, soil testing and inspection.
This project was located in COUNCIL DISTRICT 4, Mapsco 65N.
This M&C does not request approval for a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, of
the Sewer Capital Fund. The Fiscal Year 2016 Sewer Operating Budget includes appropriations of
$26,300,046.00 for the purpose of providing Pay-As-You-Go funding for sewer capital projects. After this
transfer for Fiscal Year 2016, the balance will be $2,836,137.00. Appropriations for Little Fossil Erosion
