ORDINANCE NO ~~
AN ORDINANCE APPROPRIATING ADDITIONAL REVENUE OF THE
CITY OF FORT WORTH IN THE AMOUNT OF $50,000 FROM THE
UNAPPROPRIATED FUND BALANCE OF THE WATER AND SEWER FUND
TO THE GENERAL FUND WATER AND SEWER ACCOUNT NO.
60-90-10 FOR THE PURPOSE OF PAYING VINSON & ELKINS FOR
WORK TO BE PERFORMED REGARDING THE AMENDMENT OF WATER
PERMIT NO 2413 BEFORE THE TEXAS WATER COMMISSION;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF' PRIOR ORDINANCES; REPEALING ALL
PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS;
SECTION 1
That the City Manager of the City of Fort Worth is hereby
authorized to appropriate $50,000 from the Unappropriated Fund
Balance of the Water and Sewer Fund and transfer it to the
General Fund Water and Sewer Account No. 60-90-10 for the purpose
of paying Vinson & Elkins the maximum sum of $50,000 for services
to be rendered on behalf of the City of Fort Worth in the amend-
ment of Water Permit No 2413 now pending before the Texas Water
Commission.
SECTION 2
Should any portion, section or part of a section of this
Ordinance be declared invalid, inoperative or void for any reason
by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections
or parts of sections of this Ordinance, which said remaining pro-
visions shall be and remain in full force and effect
SECTION 3.
That this ordinance shall be cumulative of all other ordi-
nances and appropriations for which provision has been heretofore
made and they are hereby expressly repealed if in conflict with
the provisions of this ordinance

and effect from and after the date of its passage, and it is so

The City of Fort Worth presently has a water permit (Texas Water: Commission No
2413) to impound 7,250 acre-feet of water at lake Benbrook and to divert
therefrom 725 acre-feet annually There exists at bake Benbrook an additional
48,792 acre-feet of potential water supply since the Army Corps of Engineers has
determined that water storage capacity is not required for navigation purposes
The City of Fort Worth has submitted a request to the Texas Water Commission
(Commission) for a permit to water rights for the additional capacity,and to
utilize the storage space in the reservoir for temporary regulation of water
pumped from East Texas The City of Weatherford has also filed a request for
the additional capacity to supplement their water supply
On December 7, 1982, a hearing will be held by the Commission to determine
whether Fort Worth or Weatherford should be entitled to contract with 'the
Corps of Engineers for the additional water storage space
The legal questions involved in this matter and the potential impact the outcome
of this matter will have on the water costs to Fort Worth citizens warrant the
hiring of outside additional legal assistance to work with the City Attorney in
handling this matter The City Attorney, City Manager and Water Director
recommend the hiring of the law firm of Vinson and Elkins to assist in this
extraordinarily important matter
As this need was not anticipated in the 1981-82 annual budget, fcsnding will be
provided from the Unappropriated Retained Earnings of the Water and Sewer Fund
Recommendation
It is recommended that
1) The City Council adopt the attached resolutign authorizing the employment
of Vinson and Elkins as outside Counsel to assist the City Attorney in
connection with water matters presently pending before the Texas Water
Commission, and,
2) The City Council adopt a supplemental appropriations ordinance appropriating
$50,000 from the Unappropriated Fund Balance of the Water and fewer Fund
to Account No 60-90-10 to provide current y?I~~~~~or the employment
