AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE AMOUNT OF $150,750.00, IN THE SEWER CAPITAL FUND, FOR THE
PURPOSE OF FUNDING EMERGENCY WORK TO REPAIR A 24-INCH SANITARY
SEWER MAIN (M-252); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
amount of$150,750.00, in the Sewer Capital Fund, for the purpose of funding emergency work to repair a
24-inch Sanitary Sewer Main (M-252).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

SUBJECT: MARY'S CREEK SEWER COLLAPSE—EMERGENCY RESPONSE
A 24" sewer line placed parallel and offset from Mary's Creek was installed in 1956 which provides
sewer collection service to areas in far west Fort Worth. With the recent heavy rains and associated
flooding,approximately 100 linear feet of the 24"clay sewer pipe was washed out,resulting in a sanitary
sewer overflow into Mary's Creek. Bypass pumping operations were initiated in order to stop the
overflow and will continue until a new sewer line can be installed. The replacement sewer line will be
moved further away from Mary's Creek and will consist of approximately 300 linear feet of 24"modern
pipe. The anticipated cost for this work is $250,000. Staff will perform the engineering, survey, and
easement work activities.The emergency bypass pumping cost associated with this work is anticipated to
be approximately$50,000.
Waiting to bid and award a contract to replace the washed out sewer line and perform emergency bypass
pumping is not the best interest of the health and safety of the City of Fort Worth. Chapter 2, Article I,
Section 2-9 of the City's Code of Ordinances and Section 252.022 of the Local Government Code
exempts from normal bidding requirements expenditures that are necessary to preserve or protect public
health or safety of the municipality's residents; and procurements necessary because of unforeseen
damage to public machinery,equipment,or property.
This memo is submitted to request authorization for emergency procurement of pump rental and
construction services. The total cost associated with this emergency is estimated to be$300,000.
A confirming M&C will be circulated to ratify the above activities after the work has been performed.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Sewer Capital Fund in the amount of$150,750.00 from available funds; and
2. Ratify an Emergency Agreement with William J. Schultz, Inc. d/b/a Circle C Construction Company,
City Secretary No. 48109, in the final amount of$150,750.00 for emergency work to repair a 24-inch
Sanitary Sewer Main (M-252).
DISCUSSION:
The 24 inch sewer line located parallel to and offset from Mary's Creek was installed in 1956 to provide
sewer collection service to areas in far west Fort Worth. With the heavy rains and associated flooding in
May and June of this year, approximately 100 linear feet of the 24 inch clay sewer pipe was washed out,
resulting in a sanitary sewer overflow into Mary's Creek.
Sanitary Sewer Overflows are a threat to the health and safety of the City of Fort Worth. Chapter 2, Article
I, Section 2-9 of the City's Code of Ordinances and Section 252.022 of the Local Government Code
exempts from normal bidding requirements expenditures that are necessary to preserve or protect public
health or safety of the municipality's residents and procurements necessary because of unforeseen
damage to public machinery, equipment, or property.
Bypass pumping operations were initiated in order to stop the overflow and continued until a new sewer
line was installed. The replacement sewer line designed by in-house engineering Staff was moved further
away from Mary's Creek. Approximately 470 LF of 24-inch pipe and five manholes were installed to repair
the sewer main. It was beyond the City's ability to perform a repair of this size, length, and depth. The
Water Department engaged William J. Schultz, Inc. d/b/a Circle C Construction Company for the
emergency repair to Sanitary Sewer Main M-252.
The attached City Manager memo dated June 23, 2016 approved the emergency work up to $300,000.00.
The total construction cost was $150,750.00, which is fair and reasonable for the work performed. The
cost for equipment rental using existing city contracts for emergency bypass pumping was $21,886.04. A
significant effort was made by Staff to remediate any impacts to the creek environment resulting from the
wastewater overflow, which is reflected in the Field Operations Staff costs associated with this emergency
response.

FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Sewer Capital Fund. The Fiscal Year 2016 Sewer Operating Budget includes appropriations of
$26,300,046.00 for the purpose of providing Pay-As-You-Go funding for sewer capital projects. After this
transfer for Fiscal Year 2016, the balance will be $2,685,387.00. Appropriations for M252 Emergency
Realignment Project, Mary's Creek Sewer Collapse by Fund will consist of the following:
