ORDINANCE NO ~(D
AN ORDINANCE AMENDING CHAPTER 19, ARTICLE I "DEPARTMENT
OF PUBLIC HEALTH," OF THE CODE OF THE CITY OF FORT WORTH,
TEXAS (1964), AS AMENDED, ESTABLISHING AND ORGANIZING THE
DEPARTMENT, PRESCRIBING QUALIFICATIONS AND DUTIES OF THE
DIRECTOR OF PUBLIC HEALTH, PROVIDING FOR THE GENERAL
POWERS AND DUTIES OF MEMBERS OF THE DEPARTMENT, PROVIDING
FOR THE ADMINISTRATION OF FUNDS FOR PUBLIC HEALTH PRO-
GRAMS, AND PROVIDING FOR THE DISPOSITION OF FEES COLLECTED
BY THE DEPARTMENT; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS
OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH; PROVID-
ING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE
DATE
WHEREAS, a Department of Health is provided for in Chap-
ter VIII, Section 1 of the City Charter of the City of Fort Worth;
and
WHEREAS, the City Council deems it necessary for the efficient
operation of the municipal government to redefine and expand upon
the powers and duties of the officials and employees of the
Department of Health;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS
SECTION 1
That Chapter 19, ARTICLE 1 "DEPARTMENT OF PUBLIC HEALTH," of
the Code of the City of Fort Worth, Texas (1965), as amended, is
hereafter amended to read as follows
"ARTICLE I
"DEPARTMENT OF PUBLIC HEALTH
"Sec. 19-1 Established A Department of Public Health is
hereby established, charged with promoting and protecting
the public health of the community The Department shall
be under the supervision of the Director of Public Health,
who shall be subject to appointment and removal by the
City Manager The salary of the Director of Public Health
shall be in accordance with the Compensation Plan of the
City
"Sec 19-1 1 Director of Public Health. The Director of
public Health shall be the Health Officer of the City of
Fort Worth The Director of Public Health shall be a pro-
fessional physician registered and licensed to practice
his profession in the State of Texas The Director shall
enforce all relevant laws for this jurisdiction, includ-

ing, b ut not limited to, the collection and provision of
vital records, the control of communicable diseases,
rabies control, and sanitary control The Director shall
also enforce for this jurisdiction codes and regulations
promulgated by the Texas Board of Health. The Director of
Public Health shall coordinate activities with the Texas
Department of Health and with other local Public Health
units
"Sec 19-1 2 Selection of Members of the Department. The
Director of Public Health shall have the power to appoint,
employ and remove such officers, assistants, employees and
personnel according to budgeted authorized positions or
authorized personnel overages for the efficient adminis-
tration of the affairs of the Department of Public Health
and to prescribe and fix their duties, scope and authority
and qualifications
"Sec. 19-1 3 Powers and Duties of Officers Generally The
Director and other members of the Department of Public
Health shall have the right to enter the premises of citi-
zens for the purpose of inspecting the condition of the
premises and for the purpose of enforcing the rules and
regulations concerning the Public Health and the ordi-
nances relating thereto now in force or that may be here-
after passed by the City Council In the exercise of this
right the Department and its employees shall act with good
judgment and in a reasonable manner, so as not to unneces-
sarily invade the privacy of the homes and premises be-
longing to citizens
"Sec. 19 1 4. Expenditure of Money for Public Health
Programs Through Donations, Grants, or Contracts Subject
to the approval of the City Manager and the City Council,
this Department will provide for the expenditure of money
for public health programs through receipt of donations,
grants, or contract
"Sec. 19 1 5 Fees All fees collected by the Department
shall be paid over to the City Treasurer and deposited in
the General Fund "
SECTION 2
This ordinance shall repeal every prior ordinance and provi-
sions of the Fort Worth City Code in conflict herewith but only
insofar as any portion of such prior ordinance or provision shall be
in conflict, and as to all other ordinances or provisions of the
Fort Worth City Code not in direct conflict herewith, this ordinance
shall b e and is hereby made cumulative.
SECTION 3
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,

paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences., paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained

Assistant City Manager for further approval The Department of Law has
reviewed the proposed ordinance for proper form and legal compliance
RECOMMENDATION
It is recommended that the City Ca,uncil adopt the attached ordinance
establishing and regulating the Department of Public Health
