051-025172-00, WATER AND SEWER FACILITIES TO SERVE WILL ROGERS COMPLEX, PHASE I" PROVIDING FOR A SEVERABILITY CLAUSE MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That there is hereby appropriated from the Water and Sewer Fund Unappropriated Retained Earnings to Account No 051-025172-00, the sum of $42,500 for Water Facilities to Serve Will Rogers Complex, Phase I SECTION 2 That, should any portion, section or part of a section of this Ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judg- ment shall in no way impair the remaining portions, sections or parts of sections of this Ordinance, which said remaining provisions shall be and remain in full force and effect SECTION 3 That this Ordinance shall be cumulative of all other ordinances and appropriations except in those instances where the provisions of this Ordinance are in direct conflict with such other ordinances and appropriations, in which instances said conflicting provisions are hereby expressly repealed SECTION 4 That this Ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained APPROVED AS TO er VtAY a ~ m-w Background On July 20 1982 (M&C-C-6414), the City Council authorized the City Manager to contract with Hahnfeld Associates for the design of the referenced project On September 21 1982 (M&C C-6516) the City Council approved a Change Order to increase the design fee by $2 500 to extend the storm drain from the parking lot to Montgomery Street This action was requested by Mr Don Otto, acting for the Museum of Science and History The Museum agreed to finance the Change Order and the added cost of the storm sewer extension as reflected in Alternate No 2 of the proposals Construction Bids Advertisements for construction bids were published on September 7 and 13 1982 Bids were received on September 16 1982 as follows Contractor Total Alt 461 Total Alt X62 J L Bertram Construction estimate of construction cost is $327 000 so this is a favorable low bid The apparent low bidder J L Bertram indicated a 90 calendar day construction time with its bid The construction time is critical because this project must be finished by the start of the 1983 Stock Show roiect Financ It is proposed to finance the water portion of this project by appropriating $42 50i from Water and Sewer Fund Unappropriated Retained Earnings to Account No 051-025172-00 'Water Facilities To Serve Will Rogers Complex Phase I 'and to finance the sanitary sewer portion of the project by a bond fund transfer in the amount of $33;5 00 from Account No 052-013901-00 "Unspecified Sub-Mains and Laterals to Account No 052-023136-00 "Sanitary Sewer Facilities To Serve Will i'Rogers Complex Phase i ' o provide financing for the storm drain relocation cost of $238 889 00 it will be ecessary for the Council to allocate and allot the $350 000 currently requested or this project as part of the 1982-83 Allotment for the 1982-84 Capital mprovement Program In addition it will be necessary to allocate and allot 10 000 from the "Engineering Unspecified category of the 1982-83 Allotment for the ,~~ DATE Earnings to Account No 051-025172-00 'Water Facilities To Serve Will Rogers Complex Phase I' and 2 Authorize a bond fund transfer in the amount of $33 500* from Account No 052-013901-00 'Unspecified Relocation for the Will Rogers Exhibit Building" and an additional $10 000 for project inspection and related expenses during the con- struction phase Both allocations and allotments are to come from the currently requested funds in the 82-83 Allotment for the 82-84 CIP and 4 Authorize the City Manager to execute a contract with J L Bertram Construction and Engineering Inc for the construction of the Water Sanitary Sewer and Storm Drain Relocations for the Will Rogers Exhibit Building utilizing Alternate II for an amount not to exceed $307 425 95 *Funds above th.e amount bid are necessary to
