ORDINANCE NO O ~S~
AN -ORDINANCE AMENDING ORDINANCE NO 8097 THE FORT WORTH
MECHANICAL CODE AS AMENDED BY EXEMPTING CERTAIN MAINTE-
NANCE JOURNEYMEN FROM THE LICENSING PROVISIONS OF THIS
CODE PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE
PROVIDING A SEVERABILITY CLAUSE PROVIDING A PENALTY
PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
TEXAS
SECTION 1
That Ordinance No 8097 as amended be amended by revising
Section 204(a) to read as follows
Mechanical License
Sec 204 (a) License Required Only Heating and Air
Conditioning Contractors licensed by the City of Fort
Worth, may install any and all forms of heating cooling
heating and cooling duct systems or refrigeration sys-
tems incinerators and other heat-producing appliances
regulated by this Code Such Licensed contractors may
extend to and connect thereto any gas piping that may be
required for the operation of such equipment All Electri-
cal Connections are regulated by the Fort Worth Electrical
Code
EXCEPTION Plumbing contractors holding a
valid State Plumbing License and a Fort Worth
Bond may install heating and gas fired ap-
pliances not connected with refrigeration or
cooling All L P gas piping installations shall
conform to the applicable Texas Railroad Commis-
sion regulations
EXCEPTION A Mechanical License shall not be
required for Licensed Maintenance Journeymen
holding a valid City of Fort Worth License for
repairs replacement of internal equipment of an
appliance or the maintenance thereof
Boiler and Pressure Vessels Boiler installation or
repair contractors who have been certified by an approved
testing agency testing to meet (A S M E ) American
Society of Mechanical Engineers and (A W S } American
Welding Society codes may make boiler and pressure vessel
installation and repair
Automatic Fire Extinguishing Installation A State
License and a Fort Worth Fire Department Listing are
required to obtain a permit for all automatic fire-
extinguishing system installations regulated by this
Code

SECTION 2
That this ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth Texas (1964)
as amended except where the provisions of such ordinances and codes
are in direct conflict with the provisions of this ordinance in
which event conflicting provisions of such ordinances and code are
hereby repealed
SECTION 3
That it is hereby declared to be the intention of the City
Council that the sections paragraphs sentences clauses and
phrases of this ordinance are severable and if any phrase clause
sentence paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction such unconstitutionality shall not affect
any of the remaining phrases clauses sentences paragraphs and
sections of this ordinance since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase clause sentence paragraph or
section
SECTION 4
That all rights or remedies of the City of Fort Worth Texas
are expressly saved as to any and all violations of Ordinance
No 8097 of the City of Fort Worth Texas and as to any other
ordinance affecting maintenance journeymen which have occurred at
the time of the effective date of this ordinance and as to such
accrued violations and all pending litigation both civil and
criminal whether pending in court or not under such ordinances
same shall not be affected by this ordinance but may be prosecuted
until final disposition by the courts
SECTION 5
That any person violating any of the provisions of this ordi-
nance shall be deemed guilty of a misdemeanor and each such person

shall be guilty of a separate offense for each day or portion
thereof during which any violation of any provision of this ordi-
nance is committed continued or permitted and each violation
shall be punishable by a fine not exceeding Two Hundred Dollars
($200 00)
SECTION 6
That the City Secretary of the City of Fort Worth Texas is
hereby directed to publish the caption penalty clause and effec-
tive date of this ordinance for five (5) days in the official
newspaper of the City of Fort Worth as authorized by Tex Rev
Civ Stats Art 1176b-1
SECTION 7
That this ordinance shall be in full force and effect from and
after the date of passage and publication as above specified

On August 31 1982 fM&C G-5401) City Council authorized amendment of Electrical
Code Ordinance No 8316 and Mechanical Code Ordinance No 8097, to license
maintenance electricians The Ordinances have nowt been prepared and are before
the City Council for adoption
Recommendation
It is recommended that the City Council adopt the attached ordinaxices amending the
'Electrical and Mechanical Codes Ordinance Nos 8316 and 8097 respectively
