AN ORDINANCE AMENDING CHAPTER 42 DEPARTMENT OF PUBLIC
WORKS OF THE CODE OF THE CITY OF FORT WORTH TEXAS
(1964) AS AMENDED BY ESTABLISHING A DEPARTMENT OF
TRANSPORTATION AND PUBLIC WORKS ESTABLISHING AND ORGAN-
IZING THE DEPARTMENT PRESCRIBING QUALIFICATIONS AND
DUTIES OF THE DIRECTOR OF THE DEPARTMENT OF TRANSPORTATION
AND PUBLIC WORKS DEFINING POWERS AND DUTIES OF THE DIREC-
TOR OF TRANSPORTATION AND PUBLIC WORKS AND AMENDING
SECTION 26-2 CITY TRAFFIC ENGINEER-OFFICE CREATED
APPOINTMENT OF THE CODE OF THE CITY OF FORT WORTH TEXAS
(1964) AS AMENDED BY ESTABLISHING THE OFFICE OF CITY
TRAFFIC ENGINEER WITHIN THE DEPARTMENT OF TRANSPORTATION
AND PUBLIC WORKS MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES REPEALING ALL ORDINANCES AND PROVISIONS
OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH PROVID-
ING A SEVERABILITY CLAUSE AND DECLARING AN EFFECTIVE
DATE
WHEREAS a Department of Public Works is provided for in
Chapter VIII Section 1 of the City Charter of the City of Fort
Worth and
WHEREAS the City Council finds upon recommendation of the
City M anager that the Department of Public Works should be merged
into and incorporated into a new and additional department
WHEREAS the City Council deems it necessary for the efficient
operation of the municipal government to create and establish a
Department of Transportation and Public Works
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH TEXAS

That Chapter 42 Department of Public Works of the Code of
the City of Fort Worth Texas (1964) as amended is hereby amended
to provide for a Department of Transportation and Public Works
and Sections 42-1 through 42-4 thereof are hereafter amended to read
as follows
Section 42 1 Departments Established and Organized
A Department of Transportation and Public Works is
hereby established which department shall be under the
supervision of the Director of Transportation and Public
Works who shall be subject to appointment and removal by
the City Manager The salary of the Director of Transpor-
tation and Public Works shall be in accordance with the
Compensation Plan of the City

Section 42-2 Qualifications and Duties of the Director
of Department of Transportation and Public Works
The Director of the Department of Transportation
and Public Works shall be a professional engineer regis-
tered and licensed to practice his profession in the State
of Texas
He shall be the custodian of and responsible for
maintaining all maps plans profiles and field notes
grid coordinates and other records and memoranda belonging
to the City pertaining to his office and the work thereof
all of which he shall keep in proper order and condition
with full indexes thereof All maps plans profiles
field notes grid coordinates estimates and other memo-
randa of professional work made or done by him or under
his direction and control shall be the property of the
City
Section 42 3 Further Powers and Duties of Director of
Transportation and Public Works
The Director of Transportation and Public Works
shall have charge of the opening construction paving
lighting signing marking maintenance reconstruction
and repair of all streets boulevards alleys sidewalks
thoroughfares and public ways other than those solely
serving or within water and sanitary sewer facilities He
shall have charge of the development and implementation of
all City transportation programs to provide for the effi-
cient mobility needs of Fort Worth citizens in all areas
of public transportation. He shall have charge of the
planning design construction maintenance and repair of
all public buildings owned or operated by the City and of
all public facilities owned and operated by the City
except those specifically delegated otherwise by this
ordinance (such as Water Works facilities) He shall have
the right to delegate this responsibility in writing to
using departments under mutually agreed terms where spe-
cial circumstances deem such action appropriate.
The Director of the Department of Transportation
and Public Works shall serve as the City Engineer for the
City or he may appoint an employee of the department to
serve as City Engineer and said employee shall b e a pro-
fessional engineer registered and licensed to practice his
profession in the State of Texas The City Engineer shall
approve all plans and specifications relating to the con-
struction reconstruction repair or maintenance of public
or private facilities located on under above or along
City property and rights-of-way such approval to be evi-
denced only by his signature on such plans and specifica-
tions No such work shall be commenced unless and until
such approval has been obtained
The Director of Transportation and Public Works
shall also b e responsible for the installation and proper
timing of official traffic control devices to conduct
engineering analysis of traffic accidents and to devise
remedial measures to conduct engineering investigation of
traffic conditions and to cooperate with the other City
officials in the development of ways and means to improve
traffic conditions and to carry out the means to improve
traffic conditions and to carry the additional powers and

duties imposed by the Code In this regard the Director
of Transportation and Public Works may serve as the City
Traffic Engineer or may appoint an employee of the depart-
ment to serve as the City Traffic Engineer who shall per-
form such powers and duties enumerated herein or as
enumerated in Chapter 26 of the City Code.
Section 42-4 Appointment of Employees
The Director of Transportation and Public Works
shall have the power to appoint employ and remove such
officers assistants employees and personnel as he may
deem necessary for the efficient administration of the
affairs of the Department of Transportation and Public
Works and to prescribe and fix their duties scope of
authority and qualifications

That Section 26-2 of Chapter 26 'Motor Vehicles and Traffic
of the Code of the City of Fort Worth Texas (1964) as amended is
hereafter amended to read as follows
Section 26-2 City Traffic Engineer-Office Created Ap-
pointment
The Office of City Traffic Engineer within the
Department of Transportation and Public Works is hereby
established The City Traffic Engineer shall be the
Director of Transportation and Public Works or an
employee of the department appointed by the Director of
Transportation and Public Works and shall exercise the
powers and duties so provided in this Code and other ordi-
nances of the City relative to traffic.

That this ordinance shall repeal every prior ordinance and pro-
vision of the Fort Worth City Code in conflict herewith but only
insofar as any portion of such prior ordinance or provision shall be
in conflict and as to all other ordinances or provisions of the
Fort Worth City Code not in direct conflict herewith this ordinance
shall be and is hereby made cumulative
SECTION 4
It is hereby declared to be the intention of the City Council
that the sections paragraphs sentences clauses and phrases of
this ordinance are severable and if any phrase clause sentence
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction such unconstitutionality shall not affect any of the

remaining phrases clauses sentences paragraphs and sections of
this ordinance since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such un-
constitutional phrase clause sentence paragraph or section.
That this ordinance shall take effect and be in full force and
effect from and after its passage and it is so ordained

In 1975 the City Charter was amended to provide for the establishment by
ordinance of a Department of Public Works Pursuant to that Charter amendment
Ordinance No 7292 w.as adopted by the City Council on January 26 1976 That
ordinance is now codified in the City Code as Chapter 42 "Department of Public
Works
Recently the City ManagEr recommended combining the Department.. of Transportation
and the Department of Public. Works into a single department Accordingly it
is necessary that an ordinance be adopted amending Chapter 42 of the City Code
by providing for the establishment and regulation of the Department of
Transportation and Public Works
Likewise since these two departments will be combined it is necessary to
amend by ordinance Chapter 26 of the City Code to establish the office of City
Traffic Engineer within the Department of Transportation and Public Works and to
provide that the Director of Transportation and Public Works or an employee
appointed by him shall be the City Traffic Engineer
RECOMMENDATION
It ~.s recommended that the City Council adopt the attached ordinance establishing
and regulating the Department; of Transportation and Public Works and designating
its Director as the City Traffic Engineer
