HomeMy WebLinkAboutContract 26654 CITY SECRETARY CONTRACT No Jk65q AMENDMENT TO CITY CONTRACT NO. 25513 STATE OF TEXAS § COUNTY OF TARRANT § THIS agreement is made and entered into by and between the City of Fort Worth ("City'), acting by and through Libby Watson, its duly authorized Assistant City Manager, and the Mitchell Boulevard Development Corporation (MBDC), by and through Gerald Shaw, its duly authorized President. Business address is 2517 Thannisch Avenue, Fort Worth, Texas 76105. WHEREAS, the City and MBDC have entered into an agreement identified as City Secretary Contract No 25513 fora period beginning January 12, 2000 and ending January 11, 2001; and WHEREAS it is the mutual desire of the parties to amend said Contract No. 25513. NOW, THEREFORE, THIS AGREEMENT FURTHER WITNESSETH: That the parties covenant and agree that the paragraphs numbered below and contained in City Contract No. 25513 currently on file in the office of the City Secretary are hereby amended to read as follows: 1. GENERAL PROVISIONS 1.1 Purpose 1.1.1 The express purpose of this amendment is to provide Contractor with additional time (6 months) in which to accomplish the objectives of the original contract which is to support housing development activities, in the Mitchell Boulevard area, for the benefit of low and very-low income residents. 1.2 Duration of Contract 1.2.1 This contract begins on the date of execution and ends six months thereafter. This written instrument together with Contract No. 25513 on file at the City Secretary's office and the attachment hereto, which are incorporated by reference and made a part of this agreement for all purposes, constitutes the entire contract by the parties hereto concerning the work and services to be performed under this agreement. Any prior or contemporaneous oral or written agreement, which purports to vary the terms of this agreement, shall be void. Any amendments to the terms of this agreement must be in writing and must be approved by each party to this agreement. Authorize the City Manager to renew City Secretary Contract No. 25513 with the Mitchell Boulevard Development Corporation (MBDC); and 2. Authorize the contract performance period to begin on the date of contract execution and end six months thereafter; and 3. Authorize the City Manager to extend the contract if the MBDC requests an extension. DISCUSSION: The MBDC is the development arm of the Mitchell Boulevard Model Block organization. One of their primary goals is to improve the quality of the housing stock within the Mitchell Boulevard community through new construction and rehabilitation of existing units. On January 12, 2000, the MBDC was awarded a Community Housing Development Organization (CHDO) contract (City Secretary Contract No. 25513) for the sum of $30,000 (HOME) to support site acquisition, housing development and the marketing of housing units to income-eligible citizens. The contract expired on January 11, 2001. The MBDC housing program currently has two CHDO funded, single-family houses under construction and a contract to construct one additional unit. They also have an inventory of 17 buildable lots, and 3 housing units suitable for rehabilitation. It was anticipated that all funds under this contract would have been expended by this time through the addition of staff employed to handle the development and marketing of these and other units to first-time homebuyers. However, circumstances beyond the MBDC's control have prevented the completion of the two new single-family units and forestalled the } need for additional staff. The two units under construction will be completed this month and construction and rehabilitation of additional units will commence shortly thereafter. Renewal of this contract for an additional six-month period will allow for the addition of staff needed to assist in the management of this growing program. Continued support for this additional staff will come from program income derived from the housing activities described above.
