The City of Fort Worth ("the City") as the Lessor of the Roseland Marine Theater(hereinafter referred to as the "Theater") is entitled to one free event per quarter at the Theater for public hearings, sector meetings, town hall meeting, community awareness functions, or other public interest use. However, the City will be responsible for a $100 clean-up fee associated with such use. Additional events may be negotiated between the City and LAA. 2. The rental charges stated in the rental fee schedule include clean-up fees. There will be no additional clean-up fees for those parties who pay the amount(s) stated in the rental fee schedule. 3. Padrinos (defined as those individuals or entities who participate in LAA's Padrino Program) are entitled to a 50%discount (or '/2 price) of the rental charges stated in the rental fee schedule. 4. Non-profit organizations that do not charge admission and have community awareness programs at the Theater will have a no charge fee for the facility. However, a $100 clean-up fee will be charged. 5. Security is the responsibility of the party using the Theater. LAA can arrange for security, but such security costs are the responsibility of the party using the Theater(hereinafter defined as"the party'). 6. The party renting the Theater from LAA will retain any admission income or box office sales. However, parties may negotiate with LAA on alternative fee and cost sharing agreements. 7. All concession rights belong to LAA. Concession rights may be transferred to the parties so long as all concession products are purchased from LAA. LAA will provide the concession products for use at the Theater. If the concession rights are transferred to the party using the Theater, such party will provide the manpower for concession sales and such party will be responsible for any unaccounted concession inventory. Specific procedures on concession product delivery and inventory will be provided to the party by LAA. 8. It is the responsibility of the party to provide manpower for the box office and to collect tickets at the Theater during the party's event or performance. LAA can arrange for such manpower, but such costs are the responsibility of the party renting the Theater. �Q INA [EXn ���D � r U�a Jj�lt?��Il U➢ � G o 9. In order to reserve the Theater, a deposit equal to one-half the rental fee as listed in the fee schedule will be due and payable immediately. The remainder will be due and payable on the day of the event or performance at the Theater. Such deposit is non-refundable. Alternate arrangements may be negotiated with LAA. 10. The party using the Theater is required to leave the Theater in the same condition as the Theater was found prior to such use, ordinary wear and tear excepted. 0H�cc�A& PE GuE)D ,off M(Nnaky ro City of Fort Worth, Texas 4"ayor and Council Communication DATE REFERENCE NUMBER I LOG NAME PAGE 10/24/00 L-12930 12LATIN 1 of 1 SUBJECT AUTHORIZE LEASE AGREEMENT WITH THE LATIN ARTS ASSOCIATION OF FORT WORTH FOR MANAGEMENT SERVICES OF THE ROSELAND THEATER LOCATED AT 1440 NORTH MAIN STREET, FORT WORTH RECOMMENDATION: It is recommended that the City Council authorize the City Manager to negotiate and execute a lease agreement with the Latin Arts Association of Fort Worth for five years for management services of the Roseland Theater. 1 DISCUSSION: The City received a Section 108 loan from the U.S. Department of Housing and Urban Development in 1998 for development of the Mercado de Fort Worth project in the 1400 Block of North Main Street. Part of the project is to renovate the Roseland Theater to be used as a cultural and community gathering place, and most of the reconstruction and renovation has been completed. The grand opening of the theater is scheduled for October 28, 2000. The Latin Arts Association of Fort Worth (LAA) is a non-profit organization established to promote Latin arts and culture in the City and to encourage the youth of the community to pursue a life in the arts. The proposed lease agreement with the LAA will be for five years. LAA will manage the Roseland Theater and oversee its operation and maintenance. In addition to paying rental of $1.00 per year to the City, the LAA will set up a reserve fund in the amount of $25,000.00 for the maintenance of the Roseland Theater. The lease provides for the LAA to be able to name interior rooms of the theater in honor of Fort Worth citizens. This proposed project is located in COUNCIL DISTRICT 2. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that the Engineering Department, Real Property Management Division will be responsible for the collection and deposit of the yearly rent.
