ORDINANCE NO ~,S(p ~p AN ORDINANCE AMENDING CHAPTER 19 HEALTH AND SANITA- TION OF THE CODE OF THE CITY OF FORT WORTH TEXAS (1964) AS AMENDED BY AMENDING SECTION 47 TO CLARIFY THE AUTHORITY OF THE DIRECTOR OF PUBLIC HEALTH TO APPROVE FOOD HANDLER TRAINING AND TO RENUMBER SECTION 19-48 AS SECTION 19-47A PROVIDING A FEE AND DURATION FOR THE CERTIFICATE BY AMENDING SECTION 19-48 TO PROVIDE FOR A COURSE AND CERTIFICATE FOR FOOD SERVICE MANAGERS BY ADDING SECTION 48A TO PROVIDE FOR FOOD MANAGER CERTIFICATE FEE AND DURATION BY AMENDING SECTION 19-49 TO PROVIDE FOR CERTAIN EXEMPTIONS AND TO ALLOW DUPLICATE CERTIFICATES PROVIDING THAT THIS ORDI- NANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES OR PROVISIONS OF SECTION 19 OF THE CODE OF THE CITY OF FORT WORTH REPEALING ALL ORDINANCES OR PROVISIONS OF SECTION 19 IN CONFLICT HEREWITH PROVIDING A SEVERA- BILITY CLAUSE PROVIDING A PENALT Y PROVIDING FOR PUBLICATION AND PROVIDING FOR AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That Section 19-47 of Chapter 19 of the Code of the City of Fort ~nlorth Texas (1964) as amended be and is hereby amended to read as follows Section 19-47 Same - Food handler s certificate required Every person who handles food in a food products establishment as defined in Sec 19-35 above shall have in his possession at all times a food handler s certif- icate issued by the Director of Public Health stating that such person has satisfactorily completed a food handler s training course or equivalent training as approved by the Dir ector of Public Health No per son who operates any food establishment shall employ any person to work in such food establishment who does not have a valid food handler s certificate issued by the Director of the Department of Public Health evidence of current food handler s certification shall be main- tained for each employee by each food establishment operator Th e Director of the Department of Public Health may cancel a food handler s certificate of any person when such person is found to have any communi- cable disease or is a carrier of such disease or is otherwise found by the Director to be unsuitable for receipt of a Certificate The Director of the Depart- ment of Public Health may require the examination of any food handler at any time SECTION 2 That a Section 19-47A be and hereby is added to Chapter 19 of the Code of the City of Fort Worth Texas (1964) to read as follows .~ min F. a;, i- Section 19-47A Same - Duration of certificates fee required on renewal Every person who is required to have a food handler s certificate issued by the Director of the Department of Public Health shall pay such department the total sum of Four Dollars ($4 00) for participation in any food handler s training course and the issuance of food handler s certificate to be valid for a period of twelve (12) months unless cancelled The fee shall be paid upon the issuance of each new certificate or renewal thereofoIn case of loss duplicate certificates may be obtained for a fee of Two Dollars ($2 00) SECTION 3 That Section 19-48 of Chapter 19 of the Code of the City of Fort Worth Texas (1964) as amended be and is hereby amended to read as follows Section 19-48 Same - Food manager s certificate Any person employed in a managerial or supervisory capacity in any food establishment shall complete a food manager s training course or equivalent training or examination as approved by the Director of Public Health Certification of completion of such course may be accepted in place of the food handler s certifica- tion prohibitions and authority for cancellation shall apply as in Section 19-47 of this Chapter SECTION 4 That Section 19-48A be and is hereby added to Chapter 19 of the Code of the City of Fort Worth Texas (1964) as amended to read as follows Section 19-48A Same - Duration of certificates fee required on renewal All food manager s certificates shall be valid for a period of thirty-six months from the date of their issuance unless cancelled The fee of Twelve Dollars ($12 00) as herein provided for shall be paid upon the issuance of each new certificate or any renewal there- of In case of lass duplicate certificates may be ob- tained for a fee of Two Dollars ($2 00) SECTION 5 That Section 19-49 of Chapter 19 of the Code of the City of Fort Worth Texas (1964) as amended be and is hereby amended to read as follows -2- ~~ ..~ Section 19-49 Exemptions Persons participating as volunteer food handlers performing charitable activities for periods of four (4) days or less may be exempted from provisions of Sections 19-47 19-47A 19-48 19-48A " SECTION 6 That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth Texas (1964) as amended except where the provisions of this ordinance are in direct conflict with the provisions of such ordinance and such Code in which event conflicting provisions of such ordi- nances and such Code are hereby repealed SECTION 7 That it is hereby declared to be the intention of the City Council of the City of Fort Worth Texas that the sections paragraphs sentences clauses and phrases of this ordinance are severable and if any section paragraph sentence clause or phrase of this ordinance shall be declared void ineffective or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction such voidness ineffectiveness or unconstitutionality shall not affect any of the remaining sec- tions paragraphs sentences clauses or phrases of this ordi- nance since the same would have been enacted by the City Council without the incorporation herein of any such void ineffective or unconstitutional section paragraph sentence clause or phrase SECTION 8 That any person firm or corporation who violates disobeys neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Hundred and No/100 Dollars ($200 00) for each offense Each day that a violation is permitted to exist shall constitute a separate offence -3- ~.
