STATE OF TEXAS § COUNTY OF TARRANT § AMENDMENT OF CITY SECRETARY CONTRACT NUMBER 29281 THIS AMENDMENT to City Secretary Contract Number 29281 is made and entered into this the day of N&) (� , 2004, by and between the CITY OF FORT WORTH, a home rule municipal corporation of the State of Texas, located within Tarrant, Denton and Wise Counties, Texas (Hereinafter referred to as the "CITY") and the BOARD OF TRUSTEES of the FORT WORTH INDEPENDENT SCHOOL DISTRICT, a political subdivision of the State of Texas and a legally constituted Independent School District located within Tarrant County, Texas. (Hereinafter referred to as the "FWISD"). RECITALS This Amendment to City Secretary Contract Number 29281 is made under the authority granted to the CITY and the FWISD by and pursuant to the Texas Government Code, Chapter 791, known as the INTERLOCAL COOPERATION ACT. WHEREAS, on October 28, 2003 the City and FWISD entered City Secretary Contract Number 29281, which outlined respective and mutual responsibilities of the District and the City in the funding and the administration of the after-school program; and WHEREAS, City Secretary Contract Number 29281 established the Fort Worth Coordinating Board, which consists of three positions from FWISD, four positions from the City and two positions from community institutions; and WHEREAS, in order to diversify the membership for the Board and to add additional community resources, the Fort Worth After School Coordinating Board voted on November 20, 2003 to increase the number of individuals on the Board, pending approval by the Fort Worth Board of Education and the Fort Worth City Council; and WHEREAS, the proposed action would increase the number of the Coordinating Board members from nine to thirteen. In addition to four representatives each from FWISD and the City, the new membership will allow for five community members; and NOW THEREFORE, in consideration of the mutual covenants herein expressed, the parties agree as follows: AGREEMENT 1. That the City and the FWISD, for and in good and valuable consideration of the mutual covenants and agreements contained herein, do mutually covenant and agree that City Secretary Contract No. 29281, on file in the office of the City Secretary of the City of Fort Worth, is hereby amended by amending Section 1. to increase the membership on the Fort Worth After School Coordinating Board as follows: 1. Section 1: City and District together covenant and agree to fully cooperate in the operation of this project and both parties agree that: A. A Coordinating Board shall oversee the implementation and operation of the After-School Program. The Coordinating Board shall consist of thirteen positions. Members of the Board shall serve no more than two terms of three years each, however, positions with asterisks (*) are permanent board members and will not be affected by the term limit rule. Community members will be selected by the Coordinating Board. FWISD - Four Positions 1. Representative of the Superintendent, FWISD* 2. Executive Director, Student Affairs* 3. Elementary Management- Assistant Superintendent or Director* 4. Director, Art Education or Instructional Music or Athletics City of Fort Worth—Four Positions 5. Representative of the City Manager, City of Fort Worth* 6. Chief of Police, City of Fort Worth or designated representative* 7. Director, Parks and Community Services, City of Fort Worth* 8. Representative - Community Relations, Public Health or Public Library department. Community Members—Five Positions 9. Crime Prevention Resource Center, Director* 10. Tarrant County Juvenile Services, Director or Assistant Director* 11. At-large Community Member 12. At-large Community Member 13. At-large Community Member At-large Community members shall have experience that includes one or more of the following categories: • Fort Worth Council of PTAs • FWISD District Advisory Board • Child Care Management System (CCMS) • Tarrant County Work Advantage • United Way etro Tarrant County Y of Metropolitan p Y 2 • Legal professions • Financial professions • Health and wellness professions • Marketing/media professions • Foundations or philanthropy • Evaluation All other terms and conditions of Section 1. shall remain in full force and effect throughout the term of this Agreement. 2. All other terms and conditions of City Secretary Contract No. 29281, which are not amended herein, shall remain in full force and effect throughout the term of this Agreement. In the agreement, a Coordinating Board was established to provide oversight in implementation and operation of the program. In order to diversify and access additional community resources the Fort Worth After School Coordinating Board voted on November 20, 2003 to increase the number of individuals on the FWAS Coordinating Board, pending approval by Fort Worth City Council and FWISD Board of Education. The proposed action would increase the number of Coordinating Board Members from 9 to 13. In addition to 8 representatives from the FWISD and the City, the new membership would allow for 5 community members. (Please see structure on page 2 of the proposed Amendment) ALTERNATIVES: 1. Approve the Amendment. 2. Remand to administrative staff to explore other alternatives. SUPERINTENDENT'S RECOMMENDATION: Approve the Amendment. COSTS: There are no costs associated with this amendment. RATIONALE: The existing structure has served Fort Worth After School very well in the initial years, not only overseeing the program, but in helping to strengthen working relationships among the City and FWISD staff. Now that the program is operational, it is time to diversify the board and bring in new board members with expertise that can strengthen the program in the following ways: increase community perspective, bring additional technical and professional expertise, and help with community collaborations and future funding.
