AN ORDINANCE MAKING CERTAIN FINDINGS: PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH , TEXAS, AND THE ANNEXA- TION OF CERTAIN TERRITORY CONSISTING OF 40 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS , PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE . WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hall of Fort Worth, Texas , on the 20th day of January, 1969, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described terri - tory on the 8th day of January, 1969, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the population of the City of Fort Worth , Texas , is in excess of 400,000 inhabitants ; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 198.222 square miles on January 1 , 1969, and WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the territory hereinafter described contains approximately 40 acres; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas , and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth , Texas , and the present boundary limits of said City, at the various points contiguous to the area within the corporate limits of the City of Fort Worth, Texas , to wit: Being a tract of land about 8 1/2 miles Southwest from the Court House of Tarrant County, Texas, and lying in the M. E. Asbury Survey, and being more particularly described as follows: BEGINNING at a point in the present City Limits ; said point being in the East line of the M. E. Asbury Survey, Abstract No. 49, and the southeast right-of-way line of the G. C. & S. F. Railroad right-of-way; THENCE Southwesterly with the Southeast right-of-way line of said G. C.& S.F. Railroad to its intersection with the South line of the M. E . Asbury Survey, Abstract No. 49; THENCE East with the South line of the M. E. Asbury Survey, Abstract No. 49, to the West line of County Road 1089, also known as the Old Granbury Road; THENCE Northerly with the West line of County Road No. 1089 to the point of beginning, and containing approximately 40 acres , more or less . SECTION 2. The above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all of the citizens and shall be bound by the acts , ordinances, resolutions and regulations of the City of Fort Worth , Texas . SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in con- flict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. - 2 - SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional , by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sec- tions , subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. ATE REFERENCE SUBJECT: Notice Of Public Hearing On PAGE 1/6/69 NUMBER Contemplated Annexation in Southwest PZ-313 Fort Worth (M. E. Asbury Survey) i or At the request of the City Council the City Plan Commission is continually reviewing the status of unincorporated areas adjacent to the City of Fort Worth for the purpose of determining which of these unincorporated areas should be annexed to the city. The City Plan Commission has studied and recommends annexa- tion of an area in Southwest Fort Worth immediately west of the Wedgwood Addition, an area experiencing much rapid change and growth. The area currently recommended for annexation contains approximately 40 acres and is bounded by the G.C. & S.F. railroad track on the north and west, Old Granbury Road on the east and the south line of the M. E. Asbury Survey on the south. Recent Improvements in the Area The City has just completed the paving of Old Granbury Road as a major thorough- fare up to the property. The Essex Company, developars- of Wedgwood, are develop- ing apartment sites on the east side of Old Granbury Road across from the subject property. The Dan Danciger Jewish Community Center's building lies immediately south of the Wedgwood development and east of the subject property proposed for annexation. Further improvements to Old Granbury Road immediately adjacent to the subject property are contemplated in the near future. All utilities and City services are available for extension into this property under the terms of the development policies any time they are requested by the owners. Recommendation It is recommended that the City Council adopt a res-olutivn setting January 20, 1969, at 9:30 a.m. as the time for public hearing on the contemplated annexation and authorizing and directing the City Secretary to publish the notices required by State Statute.
