HomeMy WebLinkAboutOrdinance 22457-10-2016 ORDINANCE NO. 22457-10-2016 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PACS GAS LEASE CAPITAL PROJECT LEGACY FUND IN THE AMOUNT OF $60,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING MASTER PLAN DEVELOPMENT AND ADMINISTRATIVE COSTS FOR THE ALLIANCE PARK PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the PACS Gas Lease Capital Project Legacy Fund in the amount of$60,000.00, from available funds, for the purpose of funding master plan development and administrative costs for the Alliance Park Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 22393-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate $60,000.00 to fund the master plan development and administrative costs for the Alliance Park Project. After the completion of the full scope of multiple projects, remaining funding was returned to the unspecified balance. This M&C authorizes the use of these project savings for the Alliance Park Master Plan. The Alliance Park Master Plan is consistent with fiscal policy regarding use of gas well revenue funding. Proposition Two of the 2014 Bond Program allocates $1,841,600.00 for, among other things, the development of additional athletic fields and supporting infrastructure throughout the City in various public parks, including locations where City funds can be leveraged through Agreements with other organizations, agencies, municipalities or school districts to create expanded athletic opportunities or to improve accessibility. On October 14, 2014 (M&C G-18337), City Council approved the Initial Implementation and Allocation Plan (Plan) for the full bond-funded amount of$1,841,600.00, which includes an allocation of$1,000,000.00 for the development of athletic fields at the future Alliance Park in cooperation with Hillwood Alliance Services, LLC. On March 24, 2015, the City Council adopted Resolution No. 4429-03-2015 authorizing the Park and Recreation Department (PARD) to apply for an Urban Outdoor Recreation Grant from the Texas Parks and Wildlife Department (TPWD). The application was successful and on March 24, 2016 the Texas Parks and Wildlife Commission approved the issuance of$1,000,000.00 in grant funding to the City of Fort Worth for the acquisition and development of Alliance Park. In accordance with the grant structure set forth by the TPWD for this project, the approved grant total of $1,000,000.00 is to be used for the acquisition and development of Alliance Park. The City of Fort Worth is solely responsible for the costs associated with project administration and design of Alliance Park. This M&C will fund the administrative and design tasks needed for master planning of Alliance Park. This M&C does not request approval of a contract with a business entity.
