ORDINANCE NO.22458-10-2016 AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF ALLEYS, UNNAMED STEET AND PORTIONS OF LAFAYETTE AVENUE, GENDY STREET, DEXTER AVENUE, AND BRYCE AVENUE, SITUATED IN THE THOMAS WHITE SURVEY, ABSTRACT NO. 1636, TARRANT COUNTY, TEXAS AS SHOWN ON THE PLAT RECORDED IN VOLUME 310,PAGE 32 OF THE PLAT RECORDS OF TARRANT COUNTY,TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. THAT the following alleys and streets described below: 1. Being that portion of a fifteen foot wide alley situated in the Thomas White Survey, Abstract No. 1636, being part of Block 7, Ross Heights, an addition to the City of Fort Worth, Tarrant County Texas; being as shown on the plat as recorded in Volume 310, Page 32 of the Plat Records of Tarrant County, Texas, containing 7,185 square feet (0.164 acre) of land more or less; 2. Being that portion of Lafayette Avenue, a fifty foot wide right-of-way, situated in the Thomas White Survey, Abstract No. 1636, being part of Ross Heights, an addition to the City of Fort Worth, Tarrant County Texas; being as shown on the plat as recorded in Volume 310, Page 32 of the Plat Records of Tarrant County, Texas, containing 24,068 square feet (0.552 acre) of land more or less; 3. Being all that portion of an unnamed street situated in the Thomas White Survey, Abstract No. 1636, in the City of Fort Worth, Tarrant County Texas; dedicated by deed recorded in Volume 921, page 346 of the Plat Records of Tarrant County, Texas, containing 4,177 square feet(0.095 acre)of land more or less; and as more specifically described in Exhibits "A" labeled Parcels 1 through 7 attached hereto and incorporated herein, by reference be and the same are vacated and extinguished. SECTION 2. That the easements to the lands in the above-described vacated alley and street rights-of-way are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located in the easements are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. DISCUSSION: Dunaway Associates, on behalf of the City of Fort Worth, has requested the vacation of these rights-of- way to be replatted with the adjoining property for the new arena project in the Will Rogers Memorial Center. The City Plan Commission recommended approval of this request at its meeting on July 27, 2016. An acceptable final plat (FS-16-145) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. The City does not own any fee interest in the rights-of-way, but does own the property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easement for the streets and alleys. This project is located in COUNCIL DISTRICT 7, Mapsco 76E. This M&C does not request approval of a contract with a business entity.
