ORDINANCE NO
AN ORDINANCE AMENDING ORDINANCE NO 8140 WHICH ADOPTED THE
UNIFORM PLUMBING CODE, AS AMENDED, BY AMENDING SECTION
1004 REQUIRING POLYBUTELENE PIPING TO MEET CERTAIN
STANDARDS PROVIDING FOR THIS ORDINANCE TO BE CUMULATIVE
PROVIDING A SEVERABILITY CLAUSE PROVIDING A SAVINGS
CLAUSE PROVIDING A PENALTY CLAUSE PROVIDING FOR PUB-
LICATION AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
That Ordinance No 8140, the Uniform Plumbing Code, as amended,
is hereby amended by revising
follows
Section 1004 thereof to read as
Section 1004 - Materials
(a) Water pipe and fittings shall be of brass, copper,
cast iron, galvanized malleable iron, galvanized wrought
iron, galvanized steel, lead or other approved materials
Asbestos-cement, PE, or PVC water pipe manufactured to
recognized standards may be used for cold water distribu-
tion systems outside a building All materials used in
the water supply system, except valves and similar devices
shall be of a like material, except where otherwise
approved by the Administrative Authority Polybutelene
piping may be used above ground or slab provided such
piping installation meets the Board of Plumbers' Standard
No 8-3-82-1
(b) Cast iron fittings up to and including two (2)
inches (50 8mm) in size, when used in connection with
potable water piping shall be galvanized
(c) All malleable iron water fittings shall be galvan-
ized
(d) Piping and tubing which has previously been used for
any purpose other than for potable water systems shall not
be used
(e) Water piping run below concrete floor slabs on grade
or fill shall be soft temper copper in accordance with
Section 203 of this code, installed in a system of
"looping between points of use No joints shall be per-
mitted in below floor loops of one hundred (100) feet
total length or less, and joints in longer lengths shall
be limited to couplings which shall be silver-soldered
Transition to hard temper copper piping shall be made at
each above-floor terminal of each loop not less than four
(4) nor more than eight (8) inches above the floor line,
except that a loop serving a single fixture may terminate
at a drop-ear elbow securely fastened to the construction
at the fixture branch through the wall All fixture
branches through the wall shall be firmly anchored to the
construction- to prevent movement along the axis of such
branch by means of drop-ear elbows or some equivalent
method acceptable to the Administrative Authority
Exception Polybutelene piping may be run below concrete
floor slabs on grade or fill, providing such piping
installation meets the Board of Plumbers' Standard
No 8-3-82-1

SECTION 2
That this ordinance shall be cumulative of all ordinances,
except where the provisions of this ordinance are in direct conflict
with the provisions of such ordinances, in which event conflicting
provisions of such ordinances are hereby repealed
SECTION 3
That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section
SECTION 4
That all rights or remedies of the City of Fort Worth, Texas,
are expressly saved as to any and all violations of Ordinance No
8140, as amended, and as to any other ordinance affecting plumbing
which have occurred at the time of the effective date of this
ordinance and, as to such accrued violations and all pending
litigation, both civil and criminal, whether pending in court or
not, under such ordinances, same shall not be affected by this
ordinance but may be prosecuted until final disposition by the
courts
SECTION 5
That any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor, and each such
person shall be guilty of a separate offense for each day or portion
thereof during which any violation of any provision of this
ordinance is committed, continued, or permitted, and each violation
shall be punishable by a fine not exceeding Two Hundred Dollars
($200 00)

SECTION 6
That the City Secretary of the City of Fort Worth, Texas, is
hereby directed to publish the caption, penalty clause, and
effective date of this ordinance for five (5) days in the official
newspaper of the City of Fort Worth, as authorized by
TEX REV CIV STATS , Art 1176b-1
SECTION 7
That this ordinance shall be in full force and effect from and
after the date of passage and publication as above specified

Regarding Polybutelene Piping

On:`7lugust 3 1982 the City of Font Worth's Board of Plumbers adopted ce.rta.in
guidelines (Standard No 8-3-82-1) for the ins.tallati.on of Polybutelene (PB)
- tubing in potable hot and cold water distributing systems within buildings
----These guidelines surpass current requirements for PB tubing in the Uniform
Plumbing Code: (Ordinance No 8140 as amended) It is t.h.e.re.fore necessary to
amend the Uniform Plumbing Code to cover the installation of PB piping under
the guidelines adopted by the Board of Plumbers
Section 1004(e) of the proposed ordinance calls for use of the fusion fitting
procedure as requested by the Plumbing Board 'F~e~e-~s--an,.~lternate ~ *~^~
method available known as the insert fitting In the opinion of the
Development Department staff based upon national testing either. method i
acceptable
RECOMMENDATION
It is recommended by the Plumbing Board that the City Council adopt the
attached amendment to the Uniform Plumbing Code to permit certain a.nstallation
of PB t.ubing provided they meet the requirements of Standard No 8-3-82-1
