Owner agrees to defend, indemnify and hold harmless the City of Fort Worth from and against all claims or liabilities arising out of or in connection with this Unified Sign Agreement. 7.This Unified Sign Agreement will be governed by the laws of the State of Texas. 8. This Unified Sign Agreement may be amended or terminated only in accordance with Section 6.404 (17)(7)(b) of the\ Comprehensive Zoning Ordinance of the City of Fort Worth, Ordinance No. 13896, as amended,which reads as follows: (b)A Unified Sign Agreement may be amended or terminated as follows: i) The amendment or termination agreement shall be executed by all owners of the properties included in the Unified Sign Agreement, and all lien holders, other than a taxing entity,that have an interest in land covered by the agreement or an improvement on such land. ii)A termination agreement shall be approved by the City Council if all signs on the property governed by the agreement are in compliance with City sign regulations, as if no Unified Sign Agreement had been executed.Any signs that are not in compliance shall be removed or brought into compliance prior to approval of the agreement by City Council. iii)In considering whether to approve an amendment to a Unified Sign Agreement,the City Council or Director of Planning and Development shall consider the criteria for approval of Unified Sign Agreement set out in Paragraph F.3 9. Heritage Trace Commons Unified Sign Agreement Project Information Project Description The Heritage Trace Commons development is a four parcel commercial development located near the intersection of Heritage Trace Parkway and Tehama Ridge Parkway. The property is described as tax parcel#'s 40498565 and 40460436 (Lots 1-4, Block 1, Heritage Trace Addition) and is zoned "E" Neighborhood Commercial per the City of Fort Worth zoning map. The development will consist of retail, restaurant, office, daycare, and similar uses distributed across single and multi-tenant buildings. The project will be developed through a phased approach. Applicability The Heritage Trace Commons Unified Sign Agreement shall be applicable to signage located in the Heritage Trace Commons development. Approval Criteria The Heritage Trace Commons Unified Sign Agreement meets the Criteria for Approval found in Fort Worth Code 6.410(8): 1. "All areas to be combined in the unified sign agreement must be part of a clearly defined unified commercial or industrial development constructed as a single destination point for customers and visitors". a. The development has a common name identification to the public(Heritage Trace Commons). b. Shared parking is provided throughout the development. c. Sign structures utilized for shared signage contain the common name of the development. d. The physical layout of the development results in a cohesive development, including a common private access driveway. e. The area is not a combination.of disparate premises joined solely for the purpose of initiating a unified sign agreement. The premises are linked through a common name identification to the public, common private access driveway, common parking, and internal circulation (see site plan). 2. "The signage proposed pursuant to a unified sign agreement must demonstrate an overall reduction in sign clutter as evidenced by a reduction of 50%in the number of signs that would be allowed in the absence of a unified sign agreement". a. The Sign Reduction Calculation Table exhibit and site plan demonstrate the required 50% reduction in the number of signs that would be allowed in the absence of a unified sign agreement. 1 ®fig 3. "No more than 50%of the advertised message area maybe used by one tenant". a. The sign will not be utilized in away that allows more than 50%of advertised message area to be used by a single tenant. 4. "A unified sign agreement shall be authorized only in an "E" or more intensive zoning district". a. The property,per the City of Fort Worth, Texas zoning map, is zoned"E"Neighborhood Commercial. 5. "Property can be subject to only one unified sign agreement". a. This agreement is the only unified sign agreement for the property. No record of any other unified sign agreements was found. Detached Sign Reduction Table The number of detached signs allowed in the development has been reduced by at least 50%in accordance with Fort Worth Code 6.410(6)(2). Fort Worth Code 6.409(E) allows one sign per each platted lot. The table below demonstrates the required reduction.
