AMENDMENT No. 3 0� TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and James DeOtte Engineering, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 38511, (CONTRACT) which was authorized by M&C C-23420 on the 31st day of March, 2009 in the amount of $442 ,172 . 00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in the amount of $19,475 . 00 which was administratively authorized on December 28, 2011 and Amendment No. 2 in the amount of $331, 662 . 00 . 00 which was authorized by M&C C-26561 on November 12, 2013 . WHEREAS, the CONTRACT involves engineering services for the following project: Sanitary Sewer Main 257 Upper and Middle Village Creek Parallel Relief Main, Part 1; and WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOW TIIEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated August 18, 2016, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $273,388 . 00 . 2 . DISCUSSION: On March 31, 2009 (Mayor and Council Communication (M&C) C-23420), the City Council authorized an Engineering Agreement with James DeOtte Engineering Inc., in the amount of$442,172.00 for the Sanitary Sewer Main 257 Upper and Middle Village Creek Parallel Relief Main, Part 1. The Agreement was subsequently revised by two amendments totaling $115,162.00 as follows: Amendment No. 1 in the amount of$19,475.00 administratively authorized on December 22, 2011 and Amendment No. 2 in the amount of$95,687.00 authorized November 12, 2013 (M&C C-26561). Amendment No. 3 will allow for additional engineering services for the design of a parallel relief main adjacent to existing Sanitary Sewer Main 503 to provide additional wastewater capacity to meet future demands from Southeast Fort Worth, Burleson and Crowley. The proposed main will begin south of Lon Stephenson Road and east of Anglin Drive and will end north of Everman - Kennedale- Burleson Road and east of Anglin Drive. The alignment generally follows Village Creek for approximately 1,050 linear feet. The proposed scope of services consists of: preparation of plans and specifications, survey services, geotechnical engineering, environmental assessment, permitting, bid phase and construction phase services and ROW/Easement services. In addition to the contract amount, $700,000.00 is required for project management and real property easement acquisition. This project will have no impact on the Water Department's operating budget when complete. MWBE OFFICE: James DeOtte Engineering Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 11 percent M/WBE participation on this Amendment No.3. The City's M/WBE goal on this Amendment is 10 percent.
