AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
EAST THIRD STREET BETWEEN NICHOLS AVENUE AND THE ST.
LOUIS SOUTHWESTERN RAILWAY COMPANY OF TEXAS RIGHT-
OF-WAY, SITUATED IN THE MOORE-THORNTON & COMPANY
ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS; PROVIDING FOR THE REVERSION OF
FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of East Third Street between Nichols Street and the St. Louis
Southwestern Railway Company of Texas railroad right-of-way situated in the Moore-Thornton
& Company Addition, an addition to the City of Fort Worth, Tarrant County, Texas, containing
approximately 5,320 square feet or 0.122 of an acre of land, and as more specifically described
in Exhibits"1", "2", and"3" attached hereto and incorporated herein by reference be and the
same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above described street and alley rights-of-way is released
and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LEGAL DESCRIPTION
BEING 5,320 square feet of land situated in the Moore-Thornton& Company Addition,
An addition to the City of Fort Worth, Texas, and being situated at the northeast corner
of the intersection of Nichols Street and East 3rd Street and being more particularly
described by metes and bounds as follows:
BEGINNING at the northwesterly corner of Lot 1A, Block 27 as conveyed to
Downtown Fort Worth Initiatives, Inc. by Deed Volume 12204, Page 704, said corner
also being on the.easterly right of way line of said Nichols Street;
THENCE North 27 degrees 35 minutes 02 seconds West, along said right of way line,
39.43 feet to a point for a corner, said corner being the southwesterly corner of Lot 3,
Block 21, Moore-Thornton & Company Addition and as conveyed to Hillside
Acquisition,L.L.C.by Deed Volume 12468,Page 1574;
THENCE North 60 degrees 00 minutes 00 seconds East, along the northerly right of way
line of said East 3rd Street, 143.78 feet to a point for a corner, said corner being on the
westerly right of way line of the St. Louis Southwestern Railway Company of Texas, said
corner also being the southeasterly corner of Lot 4A, Block 21, Moore-Thornton &
Company Addition and as conveyed to Hillside Acquisition, L.L.C. by Deed Volume
12468,Page 1574;
THENCE South 05 degrees 58 minutes 46 seconds East, along said railroad right of way,
42.61 feet to a point for a corner;
THENCE South 59 degrees 47 minutes 18 seconds West, along the southerly right of
way line of said East 3rd Street for a distance of 156.20 feet, to THE POINT OF
BEGINNING and containing 5,320 square feet of land.

Adopt an Ordinance Vacating a 0.122-Acre Portion of East Third Street between Nichols Street and
the Saint Louis Southwestern Railway Company of Texas Railroad Right-of-way in the City of Fort
Worth; and Waive the Purchase Value of Land
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an ordinance vacating a portion of East Third Street right-of-way between Nichols Street and the
railroad right-of-way, being approximately 40 feet wide by 133 feet long, consisting of 0.122 acre of land, in
the Moore-Thornton & Company Addition, located in the City of Fort Worth, as filed in Volume 388-124,
Page 69, Plat Records Tarrant County, Texas; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624).
DISCUSSION:
Gordon Swift Consulting Engineer, Inc., of Fort Worth, on behalf of J. Henry Interests Fort Worth, L.P.,
requests to vacate the above referenced right-of-way and to replat and incorporate it within the adjoining
property for the purpose of residential development. The City Plan Commission recommended approval of
this request at its meeting on December 23, 2005. An acceptable replat (FS-05-328) has been received.
Any existing utilities will be relocated at the applicant's expense, or retained within a designated easement,
along with an appropriate plat note that no permanent structures may be constructed or placed thereon.
The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process.
The City does not own land under or adjacent to the above referenced right-of-way. Since no City funds
have been expended to purchase property or easement rights, collection of the fee value or any portion
thereof is recommended by staff to be waived.
This request is in COUNCIL DISTRICT 9.
