AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
EVENING VIEW DRIVE, SITUATED IN THE HENRY ROBERTSON
SURVEY, ABSTRACT NO. 1259, TARRANT COUNTY, TEXAS AS
SHOWN ON THE PLAT OF THE RECORDED IN CABINET A, SLIDE
11577 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the following portions of Evening View Drive described below:
1. Being that portion of Tract 1 of Evening View Drive situated in the Henry
Robertson Survey, Abstract No. 1259, being part of Phase 5 of Fossil Hill
Estates, an addition to the City of Fort Worth, Tarrant County Texas; being as
shown on the plat recorded in Cabinet A, Slide 11577 of the Plat Records of
Tarrant County, Texas, containing 600 square feet (0.014 acre) of land more
or less;
2. Being that portion of Tract 2 of Evening View Drive situated in the Henry
Robertson Survey, Abstract No. 1259, being part of Phase 5 of Fossil Hill
Estates, an addition to the City of Fort Worth, Tarrant County Texas; being as
shown on the plat recorded in Cabinet A, Slide 11577 of the Plat Records of
Tarrant County, Texas, containing 600 square feet (0.014 acre) of land more
or less;
3. Being that portion of Tract 3 of Evening View Drive situated in the Henry
Robertson Survey, Abstract No. 1259, being part of Phase 5 of Fossil Hill
Estates, an addition to the City of Fort Worth, Tarrant County Texas; being as
shown on the plat recorded in Cabinet A, Slide 11577 of the Plat Records of
Tarrant County, Texas, containing 600 square feet (0.014 acre) of land more
or less;
4. Being that portion of Tract 4 of Evening View Drive situated in the Henry
Robertson Survey, Abstract No. 1259, being part of Phase 5 of Fossil Hill
Estates, an addition to the City of Fort Worth, Tarrant County Texas; being as
shown on the plat recorded in Cabinet A, Slide 11577 of the Plat Records of
Tarrant County, Texas, containing 600 square feet (0.014 acre) of land more
or less;
5. Being that portion of Tract 5 of Evening View Drive situated in the Henry

Robertson Survey, Abstract No. 1259, being part of Phase 5 of Fossil Hill
Estates, an addition to the City of Fort Worth, Tarrant County Texas; being as
shown on the plat recorded in Cabinet A, Slide 11577 of the Plat Records of
Tarrant County, Texas, containing 600 square feet (0.014 acre) of land more
or less;
and as more specifically described in Exhibits "A" labeled Tracts 1 through 6 attached
hereto and incorporated herein, by reference be and the same are vacated and
extinguished.
SECTION 2.
That the easements to the lands in the above-described vacated alley and street rights-of-
way are hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended by the City Plan Commission that the City Council:
1. Adopt the attached ordinance vacating portions of Evening View Drive to be replatted with the adjoining
property by Bloomfield Homes, LP, to realign the street intersections within the Watersbend North
subdivision; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Goodwin and Marshall, Inc., on behalf of Bloomfield Homes LP, has requested the vacation of these
portions of right-of-way to be replatted with the adjoining property to realign the street intersections with
the adjoining subdivision, Watersbend North. The City Plan Commission recommended approval of this
request at its meeting on March 23, 2016. Acceptable final plats (FP-15-116 and FP-16-048) have been
received in accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process. The City does not own any fee interest in the right-of-way or own any property adjacent to the
rightsof-way and did not expend any City funds to purchase the right-of-way easement. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easement for the street and alley.
This project is located in COUNCIL DISTRICT 7, Mapsco 19V.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds.
