AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF DARCY AVENUE AND
AN ALLEY, SITUATED IN THE J.R. MONTGOMERY SURVEY, ABSTRACT NO. 1030,
TARRANT COUNTY, TEXAS AS SHOWN ON THE PLAT OF THE RECORDED IN VOLUME
204, PAGE 4 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS:
SECTION 1.
THAT the following portions of Darcy Avenue and an alley described below:
1. Being that portion of a sixteen foot wide alley situated in the J.R. Montgomery Survey, Abstract No.
1030, as dedicated by Van Zandt's Hillside Addition, an addition to the City of Fort Worth, Tarrant
County Texas; being as shown on the plat recorded in Volume 204, Page 4 of the Plat Records of
Tarrant County, Texas, containing 5,583 square feet(0.128 acre) of land more or less;
2. Being that portion of Darcy Avenue situated in the J.R. Montgomery Survey, Abstract No. 1030, as
dedicated by Van Zandt's Hillside Addition, an addition to the City of Fort Worth, Tarrant County
Texas; being as shown on the plat recorded in Volume 204, Page 4 of the Plat Records of Tarrant
County, Texas, containing 25,487 square feet(0.585 acre) of land more or less;
and as more specifically described in Exhibits "A" attached hereto and incorporated herein, by reference be and
the same are vacated and extinguished.
SECTION 2.
That the easements to the lands in the above-described vacated alley and street rights-of-way are hereby released
and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities located in the easements
are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

of the southeasterly line of said 16 foot wide right—of—way with the westerly right—af—way line of Van
Cliburn Way (a 50 foot wide right—of—way) for the northeasterly corner of the tract of land described as
Tract 2 in the instrument to Museum Place Block A, Ltd recorded in Document Number D208148858, Deed
Records of Tarrant County, Texas;
THENCE with the common line of said 16 foot wide right—of—way and sold Tract 2 and the tract of land
described as Tract 1 in the instrument to Museum Place Block A. Ltd recorded in Document Number
D208148858, Deed Records of Tarrant County, Texas South 63' 12' 59" West a distance of 343.87 feet to a
5/8 Inch iron rod with a cap stamped `Dunaway Assoc LP" set for comer;
THENCE departing the common line of said 16—foot—wide right—of—way and said Tract 1 North 26. 47' 01"
West a distance of 16.05 feet to a 5/8 inch iron rod with a cap stamped 'Dunaway Assoc LP" set in the

Adopt Ordinance Vacating a Portion of Darcy Avenue and an Alley to be Replatted with the Adjoining
Property by Museum Place Block A, LTD, for a New Mixed Use and Hotel Development Within Museum
Place (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended by the City Plan Commission that the City Council:
1. Adopt the attached ordinance vacating a portion of Darcy Avenue and an alley to be replatted with the
adjoining property by Museum Place Block A, LTD, for a new mixed use and hotel development within
Museum Place; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Dunaway Associates, on behalf of the Museum Place Block A, LTD, has requested the vacation of these
rights-of-way to be replatted with the adjoining property for a new mixed use and hotel development within
Museum Place. The City Plan Commission recommended approval of this request at its meeting on
August 24, 2016. An acceptable final plat (FS-16-150) has been received in accordance with the
Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting
process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easement for the street and alley.
This project is located in COUNCIL DISTRICT 9, Mapsco 76A.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds.
