AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
SOUTHGATE DRIVE, LOCATED IN BLOCKS 67, 67A AND 71, SOUTH
HILLS ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS SHOWN IN THE PLAT THEREOF
RECORDED IN VOLUME 388-9, PAGE 551 OF THE PLAT RECORDS OF
TARRANT COUNTY, TEXAS, CONTAINING APPROXIMATELY 15,576
SQUARE FEET OR 0.3576 ACRES OF LAND MORE OR LESS;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING
THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Southgate Drive (a variable width public right-of-way), located in
Blocks 71, 67 and 67A, South Hills Addition, an addition to the City of Fort Worth, Tarrant
County, Texas, as shown in the plat thereof recorded in Volume 388-9, Page 551 of the Plat
Records of Tarrant County, and containing 15,576 square feet or 0.3576 acres of land more or
less, and as more specifically described in Exhibit "A" attached hereto and incorporated herein
by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.

SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a tract of land located in the City of Fort Worth, Tarrant County, Texas, part of t]John Jennings Survey, Abstract No. 851, being a portion of Southgate Drive as dedicated by the South Hills, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in 388-9, Page 551, Plat Records, Tarrant County, Texas and being more particularly descrfollows:
BEGINNING at a 1/2 inch iron rod found at the intersection of the northerly right-of-way
Southgate Drive (an 80' public right-of-way) and the west right-of-way line of McCart Street (a
variable width public right-of-way), same being the southeast corner of Lot 4, Block 67-A said South
Hills addition;
THENCE, along the west right-of-way of McCart Street and the east line of the herein described
tract, South 00 degrees 05 minutes 32 seconds East, a distance of 116.30 feet to a 5/8" iron rod
with cap stamped "SCI" set at the intersection of the said west right-of-way line and the southerly
right-of-way line of said Southgate Drive, being the most easterly northeast corner of Lot 1, Block
71, South Hills, an addition to the City of Fort Worth as recorded in Volume 388-12, Page 84, Plat
Records, Tarrant County, Texas, the beginning of a non-tangent curve to the left;
THENCE, along the southerly right-of-way of Southgate Drive and the northerly line of said Lot 1 as
follows:
Along said non-tangent curve to the left through a central angle of 118 degrees 32 minutes
29 seconds, a radius of 15.00 feet, an arc length of 31.03 feet, a chord bearing of North 59 degrees
21 minutes 46 seconds West and a chord distance of 25.79 feet to a 5/8" iron rod with cap stamped
"SCI" set;
South 61 degrees 22 minutes 00 seconds West, a distance of 147.03 fee to a 5/8" iron rod
with cap stamped "SCI" set for the southwest corner of said Lot 1, being in the northeast line of
Lubbock Avenue (50' R.O.W), the beginning of a non-tangent curve to the left;
THENCE, along the northeast line of Lubbock Avenue and along said non-tangent curve to the left
through a central angle of 00 degrees 05 minutes 22 seconds, a radius of 260.72 feet, an arc length
of 0.41 feet, a chord bearing of North 28 degrees 40 minutes 16 seconds West and a chord distance of
0.41 feet to a 5/8" iron rod with cap stamped "SCI" set for the beginning of a non-tangent curve to
the left;
THENCE, along said along said non-tangent curve to the left through a central angle of 124 degrees
54 minutes 57 seconds, a radius of 50.62 feet, an arc length of 110.36 feet, a chord bearing of
North 56 degrees 10 minutes 32 seconds West and a chord distance of 89.77 fee to a 5/8" iron rod
with cap stamped "SCI" set in the northerly right-of-way line of Southgate Drive, being in the
southerly line of Lot 11, Block 67, said South Hills addition;
THENCE, along the northerly right-of-way line of Southgate Drive and the southerly line of said Lot
11, North 61 degrees 22 minutes 00 seconds East, passing at a distance of 103.77 feet a 5/8" iron
rod found at the east corner of said Lot 11 and the southwest right-of-way line of Lubbock Avenue
(50' R.O.W.), passing at a distance of 153.77 feet a 5/8" iron rod found at the south corner of said
Lot 4 and the northeasterly right-of-way line Lubbock Avenue, continuing along the southerly line of
said Lot 4 for a total distance of 257.28 feet to the POINT OF BEGINNING and containing 15,576
square feet or 0.3576 acres of land more or less.

Repeal Resolution No. 4624-05-2016 and Adopt Ordinance Vacating a Portion of Southgate Drive to be
Replatted with the Adjoining Property by QuickTrip to Realign the Commercial Driveway Entrance into the
QuikTrip near the Intersection of McCart Avenue and IH-20 (COUNCIL DISTRICT 6)
RECOMMENDATION:
It is recommended by the City Plan Commission that the City Council:
1. Repeal Resolution No. 4624-05-2016 and adopt the attached ordinance vacating a portion of
Southgate Drive to be replatted with the adjoining property by QuikTrip to realign the commercial driveway
entrance into the QuikTrip near the intersection of McCart Avenue and IH-20; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
On May 3, 2015, the City Council adopted Resolution No. 4624-05-2016 closing a portion of Southgate
Drive to alleviate traffic in the surrounding neighborhood. Over the summer the Texas Department of
Transportation in discussion with QuikTrip requested as part of construction a deceleration lane along IH-
20 that QuikTrip work with the City to realign Southgate or their entrance to their gas station to provide a
safer condition.
Survey Consultants Inc., on behalf of QuikTrip, has requested the vacation of this right-of-way to be
replatted with the adjoining property to realign the commercial driveway entrance into the QuikTrip located
near the intersection of McCart Avenue and IH-20. The City Plan Commission recommended approval of
this request at its meeting on August 24, 2016. An acceptable final plat (FS-15-263) has been received in
accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process. The City does not own any fee interest in the right-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easement for the street and alley and repealing Resolution No. 4624-
05-2016.
This project is located in COUNCIL DISTRICT 6, Mapsco 90T.
This M&C does not request approval of a contract with a business entity.
