AND INVOLV- ING LOWER-INCOME CITIZENS IN THE DECISION-MAKING PROCESS FOR PROJECTS INITIATED WITH FUNDING FROM THE COMMUNITY SERVICES ADMINISTRATION OF THE UNITED STATES PROVIDING FOR THE COMPOSITION NUM- BER OF MEMBERS MANNER OF SELECTION AND FUNCTIONS OF SUCH COUNCIL PROVIDING FOR THE CREATION OF A DIVISION OF THE HUMAN RESOURCES DEPARTMENT OF THE CITY TO BE KNOWN A5 THE NEIGHBORHOOD RESOURCES DEVELOPMENT PROGRAM PROVIDING FOR THE APPOINTMENT OF A NEIGHBORHOOD RESOURCES DEVELOPMENT 000RDINA- TOR AUTHORIZING THE MAKING OF RECOMMENDATIONS TO THE CITY COUNCIL PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE 5' V.n ~~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 A Neighborhood Resources Development Council is hereby estab- lished for the purpose of assisting the City Council in setting priorities and involving lower-income citizens in the decision-making process for projects initiated with funding from the Community Ser- vices Administration of the United States SECTION 2 The Neighborhood Resources Development Council herein provided for shall consist of fifteen (15) members, five (5) of whom shall be public officials or their representatives, five (5) of whom shall be representative of the poor and five (5) of whom shall be officials or members of community groups, as follows Place 1 City Council 2 City Council 3 the initial appointments hereunder, the members of the Neighborhood Resources Development Council shall hold office for a term of two (2) years unless removed prior to the completion of such term The initial appointments of members to even-numbered places shall be for a term of two (2) years the initial appointments of mem- bers to odd-numbered places shall be for a one (1) year term There- after, each of such places shall be filled by appointment for a two (2) year term No member selected for Places 6-15 shall serve for more than five (5) consecutive years, or more than ten (10,) years altogether SECTION 3 A division of the Human Resources Department of the City is here- by established to be known as the Neighborhood Resources Development Program The Program shall be administered by the Neighborhood Resources Development Coordinator under the direction of the Director of Human Resources It shall have the authority to initiate studies propose projects develop plans for financial assistance recommend and coordinate comprehensive programs and perform all functions neces- sary to conduct programs funded by the U S Community Services Admin- istration it shall have the cooperation of all departments of the City in the performance of these duties a .~; SECTION 4 A Neighborhood Resources Development Coordinator shall be appointed by the City Manager, and such officer or his authorized representative shall serve as the non-voting Secretary of the Neighborhood Resources Development Council It shall be the duty of the Secretary to prepare and be custodian of all necessary minutes and records SECTION 5 The Neighborhood Resources Development Council shall review the various proposed U S Community Services Administration projects and plans for community action programs and make recommendations to the City Council with regard to such projects and plans which assist the City Council in setting priorities and involve lower-income citizens in the decision-making process SECTION 6 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence para- graph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdic- tion such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences paragraphs and sections of this ordi- nance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitu- tional phrase, clause, sentence, paragraph or section SECTION 7 This ordinance shall be in full force and effect from and after the date of its passage and it is so ordained designation of the Greater Fort Worth and Tarrant County Community Action Agency and designati~ the City as the new agency- The affective date of the revocation is May 31 1981 To ensure that the new agency is operative by June 1 1981 it is necessary to establish. by ordinance a Neighborhood Resources Development Council (NRDC) along the lines of the Community Development Council (CDC) which will fulfill the requir meets and regulations of the U S Community Services Administration (CSA) in the same way that the CDC meets the requirements of HUD for CDBG funding In addition the City will establish a division of the Human Resources Department to be known as the Neighborhood Resources Development Program (NRDP) The NRDP will be administered by a Coordinator under the direction of the Human Resources Director It i.s proposed that the attached ordinance be approved which will set up a 15-member Council and provide for the NRDP and its Coordinator The NRDC will be made up of 5 City and County appointees (3 of whom will be City Councilmembers or their designees) 5 representatives of the poor (to be determined by democratic selectio procedures within the target committees) and 5 representatives from the private sector (who will be seleC~d by the public and poor representatives) The role of the proposed NRDC will be to help set priorities and to involve the poor in the decision-making process and will specifically include the following duties 1 To participate jointly and to concur formally in the selection of the NRDP Coordinator who will be a Ci ty employee serving in the capacity of executive director of the City N RDP and as Secretary to the NRDC 2 To exercise all powers which the City Council chooses to delegate to the NRDC 3 To oversee the extent and the quality of the participation of the poor in the City's NRDP 4 To determine subject to CSA policies the rules and procedures for the NRDC and 5 To select the officers and the executive committee if any of the NRDC Additionally according to the mandate of the Economic Opportunity Act of 1964 as amended the NRDC will deliberate and submit its written recommendations to the City Council prior to final action by the City on the following matters (unles the City Council has delegated these decisions to the NRDC) 1 Determination subject to CSA policies of major personnel organization fiscal and component of the work program After the NRDC has been constituted it will adopt regulations and rules of pro- ~edure embracing the above-described powers and duties Recommendations It is recommended
