HomeMy WebLinkAboutOrdinance 8402~: ~~ ORDINANCE NO ~,~, AN ORDINANCE VACATING, ABANDONING, AND CLOSING THE 500 BLOCK OF FLORENCE STREET ADJACENT TO BLOCK 7, J P SMITH ADDITION AND LOTS 1 AND 3, BLOCK 8, J P SMITH ADDITION FROM WEST THIRD STREET TO THE NORTH RIGHT-OF-WAY LINE OF WEST FIFTH STREET PROVIDING FOR REVERSION OF FEE IN SAID LAND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT the portion of right-of-way for Florence Street lying between West Third Street and Fifth Street between Blocks 7 and 8 of the J P Smith Addition to the City of Fort Worth and being more particularly described as follows BEGINNING at the intersection of the east right- of-way line for Florence Street and the south right-of-way line of West Third Street THENCE south along the east right-of-way line of Florence Street for a distance of 210 4 feet THENCE south 45 degrees east for a distance of 29 00 feet to a point on the north right-of-way line of West Fifth Street THENCE north 89 degrees 59 minutes west for a distance of 20 5 "feet THENCE south 84 degrees 15 minutes west for a distance of 60 47 feet THENCE north 00 degrees 04 minut4s east along the east line of said Block 8 for a distance of 1138 00 feet THENCE north 77 degrees 43 minutes west for a distance of 7 0 feet to a point on the south right-of-way line of West Third Street THENCE north 60 degrees 00 minutes east for a distance of 77 31 feet to the point of Beginning and containing 0 3 acres of land be and the same is vacated, abandoned, and permanently closed as a right-of-way for street purposes SECTION 2 That the fee to the land in the above described vacated street right-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities ~.. REQUESTED vacATlor~ COMMISSION MEETING March 25 1981 ORDINANCE NUMBER SECTOR ENTRAL BUSINESS DIST ~`®~ ` ° ~~ , ~~"`~~~ K ~"~c~'"r"t"~ FORT WORTH Tf ~Zty ®f J~`a~-t ~V'®rth, ~e~cas JD~1l~c ~~r ~~~ ~®a~~~a~ c~®~~a~~a~~~a®~a DAtE REFERENCE SUBJECT Vacation of Street J P Smith PAGE NUMBER Addition Block 7 Lots 1 & 3, 8 25 81 PZ-1076 Block 8 V-81-22 got _2_ The First United Methodist Church owner of all abutting property, has requested that the City vacate Florence Street in the 500 block adjacent to Block 7 and Lots 1 and 3 Block 8 J P Smith Addition from West Third to West Fifth Streets as shown on the attached map The subject street right-of-way is an open and fully improved public street in use, containing utility facilities and traffic controls The subject vacation request is made in order to permit a replat of the adjoining land to include the vacated right-of-way for future expansion of the building area Reviewing City departments and private uitlity companies except for the Trans- portation Department have raised no objections to this request provided the vacated right-of-way is replatted with adjacent property and utility easements are provided for existing utilities as required A satisfactory replat in com- pliance with these conditions has been submitted The Transportation Department carried out specific traffic studies relative to the feasibility of vacating Florence Street between Third and Fourth Streets On October 14 1980 the department in a letter advised the applicant that the department could not recommend closure based on an analysis of existing and projected traffic circulation needs in the CBD In February, 1981 an application requesting vacation of the 500 block of Florence Street was routinely processed by the Department of Development , including review by pertinent City departments and private utility companies The Development Review Committee during their meeting on March 19 1981, and the Plan Commission on March 25 1981 both recommended that the 500 block of Florence Street be vacated During the procedural period and during both afore- mentioned meetings, the Transportation Department reviewed their concerns regar- ding vacation and closure of the street As indicated above the Plan Commission has reviewed this request and recommends that the subject street be vacated Recommendation It is recommended that an ordinance be adopted vacating the~~5~0~b~1°o~ k~~of Florence Street adjacent to Block 7 and Lots 1 and 3 Blocke 8,; J.~`P.~..xS~ith Additi f ~ ~~ ~ ~~ ~~ on, rom West Fifth to West Third Streets + 1~ ~s .
