ORDINANCE NO ~~q- AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF FORT WORTH BY ADDING A NEW CHAPTER 45 'CITIZENS' CABLE BOARD" ESTABLISHING A CITIZENS' CABLE BOARD FOR THE CITY OF FORT WORTH CREATION AND APPOINT- MENT OF ITS MEMBERS TERMS OF OFFICE PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 "Section 45-1 Creation and Organization of Citizens' Cable Boar Terms of Of ice, etc There shall be established a citizens' board entitled the Fort Worth Citizens' Cable Board (CCB) The Board shall consist of thirteen members appointed by the City Council whose composition shall represent Education 1 Social Service 1 _ .Religion 1 Arts/Cultural 1 Public Access 1 Health Care 1 Citizens-at-Large 4 City Council Members 3 13 Ex-officio non-voting members of the Citizens' Cable Board shall be as follows City Staff 2 Company's Community Access Director 1 Company's General Manager 1 City Council members and representatives of special interest areas shall be selected for an initial term of two years and shall be limited to not more than one reappointment Citizens-at-large shall be selected for a three-year term and membership shall be limited to not more than one reappointment ~ _ ,~-~,. The Board shall adopt by-laws governing its procedures and actions coming before it " "Section 45-2 Duties and Responsibilities of Citizens' Cable oar The responsibilities of the Citizens' Cable Board shall include but not be limited to the following activities a Prepare favorable or unfavorable recommendations for requests for programming substitutions which may be submitted by the Company b Review requests for designation of public insti- tutions for the Institutional Network and on a yearly basis review the allocations and real- locations of cable channels to institutions on the Institutional Network c On a semi-annual basis after completion of the cable system review cable utilization and com- munity needs and determine whether activation of the second subscriber cable should be to the City Council d Review and make recommendations on .changes in the .company's construction schedule that would decrease the number of households passed by cable trunk feeder e Develop regulations pertaining to the use or rental of access programming equipment f On a yearly. basis submit to the City Council a budget for the allocations of $75 000 toward the funding of community program efforts g Develop gui.d.elines for the allocation and distri- bution of $100 000 from the Company to be used as matching funds to upgrade teleproduction facilities Funding recommendations on insti- tutions will be made by Council on Educational `" Television in Tarrant (CETT) to the Citizens' Cable Board -2- J, ~- h Develop regulations governing the operations of the public municipal and education access channels and the transferring of programs from the Institutional to Subscriber Network i Review and approve regulations proposed by the company regarding the use of the leased access channels j Make recommendations regarding the reassignment requests for additional or shared uses of access channels k Develop rules on the carriage of system advertising which will at minimum adhere to the guidelines set forth by the National Association of Broad- casters 1 Review rates for commercial messages on the Local Origination and access channels and develop policy for advertising and sponsorship for programming on access channels m Develop a philosophy and set guidelines concerning the use of cable as a medium to sponsor telethons or other fund-raising activities n Provide assistance in the selection and assignment of twelve half-time company paid interns o Develop guidelines on content and cost of a Community Television Workshop p Conduct with the City's Cable Communications Office the required performance evaluation after the fifth and tenth franchise years and conduct any special evaluation sessions requested by the City of Company q The Citizen's Cable Board shall arbitrate in disputes regarding the scheduling of programs and the use of equipment -3- ~~ ~~- _ ;~ :L s- s, -, . ~"~ r The Citizens' Cable Board shall make a recommendation to the City Council regarding any rate increases. proposed by the Company SECTION II That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentehces, clauses, and phrases of this ordinance are severable, and if any phrase, ~~clause sentence paragrpah or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconsti- tutionality shall not affect any o~ the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this- ordinance of any such unconstitutional phrase, clause, sentence, paragraph., or section SECTION III That this ordinance shall be in full force .anal effect from and after the date of passage APPROVED AS TO FORM AND LEGALLTY City Attorney ,ADOPTED ~ ~L ~~~9~~ EFFECTIVE. -4- ~v ay~rr DATE REFERENCE sue~ECT Ordinance Creating Citizens' PAGE NUMaER Cable Board 1 9/15/81 G-5099 . '~f~ On July 15 1980 the Fort Worth City Council issued a reQuest for proposals (RFP) to deliver cable communications service to Fort Worth Page 5 of the cable RFP states in part that "the City intends to establish, by separate ordinance a Citizens Cable Advisory Board whose responsibility shall be to assist and advise the City of Fort Worth in the administration of the franchise granted for cable communications services with particular regard to community educational and public access channels " The cable communications franchise. was granted to Sammons of Fort Worth on March 17 1981 with the adoption of Ordinance No 8291 Since that time the Council Cable Study Committee and staff have gathered information about boards already at work in other cities and have received and considered recommendations and suggestions from interested groups, individual citizens and Sammons of Fort Worth regarding the composition and function of the Citizens' Cable Board Attached is a draft ordinance describing the composition and preliminary scope of work of the Citizens' Cable Board A board of 13 voting members is proposed representing the interests of education social services religion, arts and culture public access, health care the community-at-large and the City Council Tn addition the ordinance calls for the participation of four ex officio non-voting members - two from the City staff and the Community Access Director and General Manager of Sammons of Fort Worth The Citizens' Cable Board will have broad authority in matters related to cable communications, especially in terms of public educational, and municipal access channels a11o- cat.ed to the community by Sammons of Fort Worth The Cable Study Committee proposes that names of prospective appointees to the Citizens' Cable Board be solicited from citizens and organizations within the community the Fort Worth City Council, and any othet intetesfied parties Potential candidates will be interviewed by the Study Committee and recommenda- tions for Cable Board appointments will be forwarded to the City Council for it.s consideration Recommendations for Board members should be received in the Office of Cable Communications by October 1 1981 Recommendation , A~PROV~~ '~Y It is recommended that the City Council adopt the attach~d orr'~a"~fic~°I.~tig a Citizens' Cable Board +' SEP ~.~ 198E , RAM ms -~° ~ .tx~ ~ Attachment &x ecXetary o£ the of ~oxt Woxth, Texa4 _.. _..,w.~. .._.~~..., .,.y ~....- _.._ M (C1fFICE BY: ~RRH~ µ~~ / / I C ' ` • of !
