ORDINANCE NO 8416
AN ORDINANCE VACATING ABANDONING CLOSING AND
EXTINGUISHING THE 8 25 FEET WIDE UTILITY EASEMENT
ABUTTING THE EAST PROPERTY LINE OF LOT A BLOCK
3 JUNIUS W SMITH ADDITION EXTENDING IN LENGTH
FROM THE SOUTH RIGHT-OF-WAY LINE OF WEST 7TH
STREET TO THE NORTH RIGHT-OF-WAY LINE OF WEST 10TH
~- STREET PROVIDING FOR REVISION OF FEE IN SAID LAND
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND
PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
TEXAS
SECTION 1
THAT the 8 25 feet wide utility easement abutting the
east property line of Lot A Block 3 Junius W Smith Addition
extending in length from the south right-of-way line of West
7th Street to the north right-of-way line of West 10th Street
be and the same is hereby vacated abandoned permanently
closed and extinguished as a utility right-of-way
SECTION 2
That the fee to the land in the above described
vacated utility right-of-way is hereby released and shall
revert to the adjacent owners as provided by law
SECTION 3
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed
SECTION 4
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and
it is so ordained

Burnett Plaza Associates, 2 Burnett Plaza, with consent of abutting owner, has
requested that the City vacate the utility easement along bhe east line of Lot A
Block 3, Junius W Smith Addition, a width of 8 25' from W 7th Street to W Loth
Street, being the west half of former alley vacated by Ordinance No 8202 and
retained as easement for existing utilities, as shown on the attached map
The subject easement acquired by dedication is nod in use Reviewing City
departments and ~riv~t-e utility companies have rev~~wed this request and offer
t
no objections ~ .
Recommendation
It is recommended that an ordinance be adopted vacating the subject utility
easement on Lot A Block 3, Junius W Smith Addition
