ORDINANCE NO ~ 3, AN ORDINANCE VACATING ABANDONING CLOSING AND EXTINGUISHING THE UTILITY EASEMENT BETWEEN LOTS A AND B BLOCK 1 OVERTON WOODS ADDITION A WIDTH OF 10 FEET 5 FEET ON EITHER SIDE OF THE COMMON PROPERTY LINE OF LOTS A AND B BLOCK 1 OVERTON_WOODS ADDITION AND EXTENllING IN LENGTH FROM A POINT 5 FEET NORTH OF THE NORTH RIGHT-OF-WAY LINE OF OVERTON WOODS DRIVE NORTH 80 FEET TO A POINT 85 FEET FROM OVERTON WOODS DRIVE NORTH RIGHT-OF-WAY LINE PROVIDING FOR REVERSION OF FEE IN SAID LAND REPEALING ALL ORDINANCES IN CON- FLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 THAT the 10 foot wide utility easement between Lots A and B Block 1 Overton Woods Addition a width of 10 feet 5 feet on either side of the common property line,~of Lots A and B Block 1 Overton Woods Addition and extending in length from a point 5 feet north of the north right-of-way line of Overton Woods Drive north 80 feet to a point 85 feet from Overton Woods Drive north right-of-way line be and the same is vacated abandoned permanently closed and extinguished as an easement for utility purposes SECTION 2 That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law SECTION 3 That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4 That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained APPROVED AS TO FORM AND LEGALITY City Attorney ADOPTED ~;ib~' 0 ~ / ~c~I EFFECTIVE ' City of Fort Worth, 2"exas Mayor a ~ouncal ~omm.un~~at~.on DATE REFERENCE SUBJECT Vacation of Utility Easement PAGE NUMBER Overton Woods Addition,"Lots A&B, .Block 1 1 81 ** PZ-1045 1 V-81-21 for JAIL Investments Incorporated, owner of all abutting property has requested that the City vacate the utility easement between Lots A and B, Block 1, Overton Woods Addition, a width of 10', from 5' behind the Overton Woods Drive north right-of-way line, north 80' along and 5' on Either side of the common property line of Lots A and B Block 1, Overton Woods. Addition, to a point. 85' from the Overton Woods Drive north right-of-way line as shown on the attached map The subject utility easement acquired by dedication, is platted but contains no utility facilities The subject vacation request is made in order to expand the building area and provide more usable yard space Reviewing City departments and private iltility companies have raised no objec- tions to this request Recommendation It is recommended that an ordinance be adopted vacating the subject 10' wide utility easement in and between Lots A & B Block 1 Overton Woods Additio n.
