Background Several weeks ago we were contacted by the local chapter of the American Institute of Architects asking that the appropriate changes in the Code of Ethics be made which would allow an architect to serve on a City Board or Commission and still , represent clients before other Boards and Commissions. The relevant section of the Code of Ethics reads as follows: (2) No officer or employee of the City shall knowingly: (a) Appear before the body of which the officer or employee is a member as a representative for any private person, group or interest, or represent, directly or indirectly, any private person, group, or interest before any department, agency, commission or board of the City of Fort Worth. Proposal It is proposed that the attached ordinance amending the Code of Ethics be adopted. Legality This action is within the purview of the City Council and there are no known legal impediments. Fiscal Note This action does not require an- expenditure of funds. City Manager`s Comments The City Manager concurs with this proposal. AN ORDINANCE AMENDING CHAPTER 43, ARTICLE I (CODE OF ETHICS) OF THE CODE OF THE CITY OF FORT WORTH (1964) , AS AMENDED, BY AMENDING THE PROVISIONS OF SECTION 43-l (C) (2) (a) CONCERNING APPEARANCES BY CITY OFFICERS OR EMPLOYEES, OR THEIR SPOUSES, BEFORE DEPARTMENTS, AGENCIES, COMMISSIONS OR BOARDS OF THE CITY; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HERE- WITH; PROVIDING THAT THIS ORDINANCE SHALL BE ENGROSSED AND ENROLLED; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 43-1 (C) (2) of Article I of Chapter 43 of the Code of the City of Fort Worth, be and the same is hereby amended by changing Paragraph (a) thereof to read as follows: " (a) Appear before the body of which the Officer or employee is a member as a representa- tive for any private person, group, or interest." ? SECTION 2. That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1964) , as amended, except where the provisions of this ordi- nance are in direct conflict with the provisions of such ordinance and such code, in which event conflicting provisions of such ordinances and such code are hereby repealed. SECTION 3. That it is hereby declared to be the intention of the City Council of the City of Fort Worth, Texas, that the sec- tions, paragraphs, sentences, clauses and phrases of this ordinance are severable and if any section, paragraph, sentence, clause or phrase of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final f ' decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining sections, paragraphs, sentences, clauses or phrases of this ordinance since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional section, paragraph, sentence, clause or phrase. SECTION 4. That the City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by . t copying the caption in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 5. This ordinance shall be in full force and effect from and after the date of passage, and it is so ordained.
