H.B. 1068 requires persons who are convicted of offenses in municipal courts, except pedestrian " and parking violations, to pay an additional fifty cents in court costs. The Governor' s office will use the additional costs to establish a fund to provide grants to statewide associations of municipal court judges and court personnel to conduct continuing education seminars. H.B. 1068 is defective because it does not contain an appropriation provision as required by the Texas Constitution. As a result, the Governor' s office will be unable to. withdraw or expend money from the fund. AW The Texas Municipal. Courts Association has asked the Governor to correct the defect in H.B. 1068 by adding remedial legislation to a special session of the Legislature. If this action is not taken, it will be necessary to wait until the next regular session which convenes in 1985. If funds become available, the Municipal Courts Association will hold at least eight educational seminars in 1984 in different parts of the state. These seminars would benefit Fort Worth municipal court judges and court personnel. Recommendation It is recommended that the City Council adopt the attached resolution urging the Governor to add remedial legislation for H.B. 1068 to the agenda of items to be considered at any legislative session. w Legality "PROVED BY No comment required.
