Background
The Texas Legislature recently adopted H.B. 1068, which takes effe on
January 1, 1984. H.B. 1068 requires persons who are convicted of
offenses in municipal courts, except pedestrian " and parking violations,
to pay an additional fifty cents in court costs. The Governor' s office
will use the additional costs to establish a fund to provide grants to
statewide associations of municipal court judges and court personnel to
conduct continuing education seminars.
H.B. 1068 is defective because it does not contain an appropriation
provision as required by the Texas Constitution. As a result, the
Governor' s office will be unable to. withdraw or expend money from the
fund.
AW The Texas Municipal. Courts Association has asked the Governor to correct
the defect in H.B. 1068 by adding remedial legislation to a special
session of the Legislature. If this action is not taken, it will be
necessary to wait until the next regular session which convenes in
1985. If funds become available, the Municipal Courts Association will
hold at least eight educational seminars in 1984 in different parts of
the state. These seminars would benefit Fort Worth municipal court
judges and court personnel.
Recommendation
It is recommended that the City Council adopt the attached resolution
urging the Governor to add remedial legislation for H.B. 1068 to the
agenda of items to be considered at any legislative session.

A Resolution
WHEREAS, the Texas Legislature adopted H.B 1068 which takes
effect on January 1, 1984; and
WHEREAS, H.B. 1068 requires persons who are convicted of
offenses in municipal courts, except pedestrian and parking viola-
tions, to pay an additional fifty cents in court costs; and
WHEREAS, such additional court costs are to be used by the
Governor' s office to establish a fund to provide grants to statewide
professional associations of municipal court judges and municipal
court personnel to conduct continuing education seminars; and
WHEREAS, H.B. 1068 is defective because it does not contain an
appropriation provision as required by the Texas Constitution; and
WHEREAS, the Governor' s office will be unable to withdraw or
expend any money from the fund unless remedial legislation is en-
acted to correct H.B. 1068; and
WHEREAS, the Texas Municipal Courts Association has requested
the Governor to add such remedial legislation to the agenda of items
to be considered by the Legislature at a special session; and
WHEREAS, the City Council supports such request by the
Municipal Courts Association;
NOW, , THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
1. That the City Council hereby requests that the Honorable
Mark White, Governor of Texas, include on the agenda of items to be
considered at any special session of the Legislature a bill to amend
H.B. 1068 by adding an appropriation provision.
2. That the City Secretary is hereby directed to send copies
of this resolution to the Governor, Lieutenant Governor, Speaker of
the House, all members of the Tarrant County legislative delegation,
and to the President of the Texas Municipal Courts Association.
