Background

The necessity to connect to various utilities, and the necessity rto repair
certain utilities has an adverse effect on the City's Street Maintenance pro-
gram. Often a new pavement is severely damaged by utility connections before
it is placed in service. Rupture of utility lines underneath a pavement can
also severely damage a pavement as well as digging to reach the damaged util-
ity. Even with close inspection, the patches seldom hold up as well as the
original pavement. Many cities deal with this problem by requiring that
utilities be placed in parkways, medians, and easements out from under the
pavement. The usual exceptions are sanitary sewers and storm sewers which
are installed prior to street construction and rarely need repair.
Proposal
In order to reduce the damage to pavement caused by utility operations in new
subdivisions and in border streets adjacent to new subdivisions, it is pro-
posed that effective immediately all new subdivisions will provide for utili-
ties (except for storm and sanitary sewers) out from under the pavement in
easements, parkways and medians. This will not preclude utilities from cros-
sing streets where necessary, but the crossing shall be at right angles inso-
far as practicable. Stubouts for collectors and mains should be installed
prior to paving to preclude paving cuts for service connections. Whenever
platting or replatting of adjacent property results in the existing stubouts
being inadequate and pavement cuts are necessary, staff may require, as a
• condition of the plat, the resurfacing of one or more entire blocks of
street. This policy will apply to all projects that do not have either
approved engineering plans or an approved Community Facilities Agreement as
of the date of passage by the City Council .
Financing
This proposal will have little direct financial impact in the near term, but
should substantially reduce street maintenance and repair costs in the
future.
Legality
The City Attorney has reviewed the above policy and there are no known legal
impediments that would prohibit the implementation of the proposed policy.
