ORDINANCE NO ~~.3~
AN ORDINANCE VACATING ABANDONING CLOSING AND
EXTINGUISHING THE 24 FOOT WIDE EMERGENCY ACCESS
AND UTILITY EASEMENT ADJACENT TO THE EAST PROPERTY
LINE. OF LOTS C AND E AND THE WEST PROPERTY LINE
OF LOT F BLOCK 1 THE STAIR AT BRENTWOOD STAIR
ADDITION AND EXTENDING FROM THE NORTH RIGHT-OF-WAY
LINE OF BRENTWOOD STAIR ROAD NORTH TO THE SOUTH
RIGHT-OF-WAY LINE OF ACRO.SS~ STAIR DRIVE AND THE 2
20 FOOT BY 20 FOOT TRIANGULAR PUBLIC OPEN SPACE
EASEMENTS IN THE SOUTHEAST CORNER OF LOT E AND THE
SOUTHWEST CORNER. OF LOT F' BLOCK 1 THE STAIR AT
BRENTWOOD STAIR ADDITION RECORDED IN VOLUME 388-121
PAGE 60 PLAT RECORDS TARRANT COUNTY TEXAS PRO-
VIDING FOR REVERSION OF FEE IN SAID LANDS REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING
AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS
SECTION 1
That the 24 .foot wide emergency access and utility easement
adjacent to the east property line of Lots C and E and the west
property line of Lot F Block 1 The Stair at Brentwood Stair Addition
and extending from the north right-of-=way line of Brentwood Stair
Road north to the south right-of-way line of Across Stair Drive
and the 2 20 foot by 20 foot triangular public open space easements
in the southeast corner of Lot E and the southwest corner of Lot F
Block 1 The Stair at Brentwood Stair .Addition recorded in Volume
388-121 page 60 Plat Records Tarrant County Texas be and the
same is vacated abandoned and permanently closed and extinguished
as emergency access and utility easements and public open space
easements
SECTION 2
That the fee to the lands in the above described vacated
emergency access and utility easements and public open space easements
is hereby released and shall revert to the adjacent owner as provided
by law
SECTION 3
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed
SECTION 4
That this ordinance shall take effect. and be in full force
and effect from and after the date of its passage and it is so
ordained

Mr C C Gumm, owner of all abutting property has requested that the City vacat
th.e following easements
(a) The 24' wide emergency access and utility easement identified as Down-
stairs Drive (a private street), located adjacent toy the east line of
Lots C and E, extending from Brentwood Stair Road north to Across Stair
Drive ( a private street) and
(b) The 20'x20' triangular public open space easements on either side of said
private street (Downstairs Drive) at its intersection with Brentwood
Stair Road all located in Lots E and F, Block 1 The Stair at Brentwood
Stair Addition recorded in Volume 388-121 page 60 Plat Records Tartan
County, Texas, and as-shown on the attached map +~
The subject easements acquired by dedication are in use but contain no utility
facilities The subject vacation request is made in order to permit relocation
and rededication of said easement 7 5' east of its present .location to eliminate
encroachment of an existing building
Reviewing City departments and private utility companies have raised no objec-
tions to this request provoded said easements are replatted with abutting propert
and relocated 7 5' east of their present location 2, satisfactory replat has bee
submitted
Recommendation
It is recommended that an ordinance be adopted vacating the subject easements in
Lots C, E and F, Block 1, The Star at Brentwood Stair Addition
