DISCUSSION• °sw The City Council Inter and Intra Governmental Relations Committee directed the City Staff to draft the proposed Policy which is attached. The Policy contains the following provisions: • 1. Bidders on city contracts that involve an expenditure in excess of $15,000 will be required to submit a Certification Form with their bids disclosing the following information: a) whether any paid agent of the bidder, has communicated with any member of the City Council or City Staff in an attempt to influence his or her vote or recommendation regarding the potential award of the contract; b) the name(s) of the paid agent(s) who communicated with member(s) of the City Council or City Staff, the name(s) of the member(s) of Council or City Staff communicated with, the nature and time of the communications) and the amount of compensation paid to the agent(s) who did the communicating. 2. Bidders are required to supplement the Certification Form to provide information about any other communications between paid agent(s) and member(s) of the City Council or City Staff which take place prior tc award of the contract. 3. Failure to comply with the Policy shall be grounds for disqualification of a bidder. On May 2, 1995, the Inter and Intra Governmental Relations Committee reviewed the proposed Policy and voted to forward it to City Council for consideration. FISCAL NOTE: The Director of Fiscal Services certifies that no expenditures of City funds is required to implement the proposed Policy. (2) "Member of the City Council" means a member of, member- elect of, or candidate for City Council. (3) "Member of the City Staff" means the City Manager, an Assistant City Manager, or a Department Head, who is responsible for making a recommendation about the award of a city contract. (4) "Paid agent" means a person who receives, or is to receive, compensation from a bidder for communicating with a member of the City Council or City Staff to attempt to influence the Councilmember's vote or Staff member's recommendation concerning the award of a city contract. "Paid agent'" does not include a bidder or a bidder's regular full- time employee who does not receive compensation for making the communication other than his or her regular compensation. (5) "Compensation" means money, a service, or anything of value that is received or to be received in return for services rendered or to be rendered; includes money, a service or anything of value to be received contingent upon the award of a contract. (b) All bidders on city contracts that involve an expenditure of more than $15,000 shall complete a Certification Form that discloses whether any paid agent of the bidder has communicated with any member of the City Council or City Staff, directly or indirectly, in an attempt to influence the Councilmember's vote or Staff member's recommendation concerning award of the contract. Communications made in public at an open session of the City Council are not required to be listed. Certification Forms shall be provided to bidders by the City Manager, or by the City Manager's designee, shall be filled out by bidders and shall be submitted with their bids. (c) The Certification Form shall list the paid agents) of the bidder who communicated with a member of the City Council or City Staff, the names of the members of the City Council or City Staff who were communicated with, and the time and manner of the communication. The Certification Form shall also list the amount of any compensation paid, or to be paid, to the agent who communicated with a member of the City Council or City Staff. (d) Bidders are required to supplement the Certification Form to provide information about any additional communication(s) between paid agent(s) of a bidder and members of the City Council or City Staff that occur prior to award of the contract. (e) Failure to comply with this Policy shall be grounds for disqualification of a bidder. -2-
