RECOMMENDATION:
It is recommended that the City Council adopt a policy for the application of the City's Minority
and Women Business Enterprise (M/WBE) Ordinance in non-city construction projects where
city funds are utilized, whether in whole or in part. Provisions will be included in the
implementation of the policy providing for the withdrawal of City funds in the event that the
terms and conditions of the ordinance are not met.
BACKGROUND:
Funds from the City of Fort Worth are being sought by organizations for the construction of
projects that are deemed to be in the public interest. When entering into agreements for these
grants, an opportunity arises to include requirements for the use of Minority and Women
Business Enterprises.
PROPOSAL:
The City Council should adopt a policy that authorizes City staff to follow the terms and
conditions of the City's M/WBE Ordinance establishing goals for the utilization of Minority and
Women Business Enterprises and to include such goals in agreements with organizations when
City funds are granted for non-city construction projects.
DECLARATION OF CITY POLICY: -
It shall be the policy of the City of Fort Worth that when the City enters into an agreement to
allocate funds to organizations to pay for all or part of the costs of construction projects, goals
for the use of Minority and Women Business Enterprises in the construction project for which
the assistance was requested shall be included in any such agreement. This policy shall not apply
to community facility agreements or projects funded with tax-exempt bonds.

DEFINITIONS:
For purposes of this policy, the following terms are defined as follows:
"Minority/Women Business Enterprise Ordinance" means City of Fort Worth Ordinance No.
11923 adopted by the Fort Worth City Council on April 18, 1995, and as it may be amended by
the City Council in the future.
"Minority Business Enterprise" means a qualified business as defined in Ordinance No.
11923.
"Woman Business Enterprise" means a qualified business as defined in Ordinance No. 11923.
"Minority" means a citizen of the United States or lawfully admitted permanent resident who is
Asian-American, American Indian,African-American or Hispanic.
"Organization" means any type of entity requesting funds from the City of Fort Worth for use
on non-city construction projects.
IMPLEMENTATION OF POLICY:
Agreements for the allocation of city funds to organizations for use in construction projects shall
include goals for the utilization of Minority and Women Business Enterprises. These goals shall
be expressed as a percentage of the total cost of the project, including but not limited to
construction and design costs, which is being assisted with city funds. The goals shall be
established in accordance with the requirements of Ordinance No. 11923 prior to the City
Council appropriating city funds for the project and the ordinance must be complied with before
City funds are expended. The following information, together with such other information as
may be requested by City staff, shall be provided by the requesting organization and will be
considered when the goals are established.
• A description of the project.
• A description of the benefits which will be provided to the citizens of Fort Worth as a
result of the construction of the project.
• The location of the project.

• If the requested funds are to be used for only a portion of a project, a complete
description and cost of that portion of the project shall be provided.
• The amount of the requested funds and a detail description of how the requested
funds will be utilized.
The type of project and the availability of Minority and Women Business Enterprises with the
skills required by the project will be considered in establishing the goals.
If an organization fails to comply with the requirements of Ordinance No. 11923, funds will be
withheld from the organization.
LEGALITY:
The City Attorney has reviewed the proposed policy and there are no known legal impediments
that would prohibit or limit the implementation of such a policy.
FISCAL NOTE:
This policy will not require any additional City funds.
CITY MANAGER COMMENTS:
The City Manager concurs with the implementation of this policy proposal and will assign
responsibility for implementation and monitoring to the Minority/Women Business Enterprise
Office.
